SUBJECT: Westlands Water District Amended Bylaws
RECOMMENDED ACTION(S):
TITLE
Approve the Amended Bylaws of Westlands Water District.
REPORT
During the March 20, 2018 meeting of its board of directors, Westlands Water District amended its bylaws by a unanimous vote of its directors and is now seeking your Board’s approval, pursuant to California Water Code, section 35305. This item pertains to locations in Districts 1 and 4.
ALTERNATIVE ACTION(S):
Your Board may choose not to approve the amended bylaws, leaving the District to seek approval from two-thirds of the total vote of the district, given either in writing or by ballot cast at a district election.
FISCAL IMPACT:
The recommended action has no fiscal impact on the County.
DISCUSSION:
The Board of Directors of the Westlands Water District adopted amended bylaws on March 20, 2018, by unanimous vote. In accordance with Water Code, section 35305, bylaws may be amended, repealed, or new bylaws adopted by the assent of two-thirds of the total vote of the district, given in writing or by ballot cast at a district election or by a four-fifths vote of the directors and approval by the board of supervisors of the principal county of the district. The County of Fresno is the principal county for Westlands Water District.
Section V. of the bylaws, “Qualification and Duties of Directors, Their Tenure of Office and Time and Manner of Their Appointment,” was amended to clarify the role of the Board’s President on various committees of the Board. Administrative Office staff consulted with County Counsel in the preparation of this item.
