SUBJECT: Resolution for Amendment No. 2 to Public Defense Pilot Program

RECOMMENDED ACTION(S):
TITLE
Adopt a resolution accepting and authorizing the County Administrative Officer to execute, subject to approval as to legal form by County Counsel, and subject to approval as to accounting form by the Auditor-Controller/Treasurer-Tax Collector, Amendment No. 2 to the Public Defense Pilot Program (PDPP) with the Board of State and Community Corrections (BSCC) for post-conviction defense, effective March 1, 2022 through December 31, 2026, total not to exceed $3,466,977, in order for BSCC to fully execute Amendment No. 2 and release Year 3 funds.

REPORT
There is no additional Net County Cost (NCC) associated with the recommended action which will accept the amendment to the PDPP Grant in order for BSCC to fully execute Amendment No. 2 and release Year 3 funds. The recommended action will also authorize the County Administrative Officer (CAO) to execute the Amendment No. 2 for the extended term, subject to approval as to legal form by County Counsel, and subject to approval as to accounting form by the Auditor-Controller/Treasurer-Tax Collector. BSCC is requesting a Resolution to acknowledge the change in terms of the Agreement (22-month extension) and the additional funds (maximum increased by $1,077,406). This item is Countywide.

ALTERNATIVE ACTION(S):

Your Board may choose not to approve the recommended action, in which case the amendment will not be executed by BSCC and the awarded funds for Year 3 and extension in term length will not be authorized. Your Board may also choose not to delegate authority to the CAO to execute the Amendment No. 2, in which event the Amendment No. 2 will need to come before your Board for approval and execution.
