SUBJECT: Amendments to Fresno County Ordinance Code Sections Related to Leave to Seek Elective Office
RECOMMENDED ACTION(S):
TITLE
Conduct second hearing of an Ordinance to amend the County Ordinance Code by deleting section 3.08.120 thereof and adding section 3.04.030 related to taking leaves of absence to seek certain elected offices; and waive reading of the Ordinance in its entirety.
REPORT
Approval of the recommended action would amend the County Ordinance Code by adding section 3.04.030 providing that the County shall establish formal personnel rules governing the taking of leaves of absence by all County employees, except elected officials, when seeking electoral office. This item is countywide.
ALTERNATIVE ACTION(S):
The Board of Supervisors could decide not to adopt the proposed amendments to the Ordinance Code.
FISCAL IMPACT:
There is no Net County Cost associated with the recommended actions.
DISCUSSION:
On October 23, 2018, your Board conducted the first hearing for the recommended amendment to the County Ordinance Code. The County currently has rules and procedures governing leave requests from employees in the Classified Civil Service for leave to seek elective office. These proposed changes to the Ordinance Code would explicitly extend coverage of the County’s formal ordinance and policies to non-civil service employees as well, except for elected officials. The proposed ordinance amendments will also allow, following any necessary meet and confer process with labor representatives, the County to adopt clear, uniform and fair rules governing the taking of administrative leave to seek certain elective offices, primarily state-wide or federal offices.
