SUBJECT: Resolution and One-Year Grant Applications for CalRecycle Local Enforcement Agency Grant Program
RECOMMENDED ACTION(S):
TITLE
1. Adopt Resolution authorizing submittal of one-year grant applications to the California Department of Resources Recycling and Recovery for Local Enforcement Agency Grant Program funds for FYs 2019-20 through 2023-24; and
2. Approve and authorize the Director of the Department of Public Health, or designee, to execute and submit one-year grant applications and all grant documents necessary to the California Department of Resources Recycling and Recovery for Local Enforcement Agency Grant Program funds for FYs 2019-20 through 2023-24 ($141,790).
REPORT
Approval of the recommended actions will authorize the submittal of five successive and separate one-year non-competitive grant applications to the California Department of Resources Recycling and Recovery(CalRecycle) for FYs 2019-20 through 2023-24 to continue the inspection and monitoring regulated solid waste facilities at the current frequency level, with no Net County Cost. The second recommended action will authorize the Director of the Department of Public Health, or designee, to execute all grant documents necessary to secure grant funding and implement the approved grant project for FYs 2019-20 through 2023-24. If awarded, the related revenue agreement will be brought to the Board for approval. This item is countywide.
ALTERNATIVE ACTION(S):
Non-approval of the recommended actions would require the Department to return to your Board for submittal of the one-year grants and the required documents, with the risk of not meeting future deadlines that are typically open for a short period.
FISCAL IMPACT:
There is no Net County Cost associated with the recommended actions. The Department will request the maximum funding amount available to the County for FY 2019-20 ($28,358), the revenue agreement is $314 less than prior allocations; the five-year allocation is estimated to be $141,790. The grant allocation is non-competitive and does not require matching funds. The grant allows for full reimbursement of direct costs but does not allow for indirect cost recovery. The Department’s current indirect cost recovery rate is 25.42%. The Department’s share of indirect costs ($7,208) in FY 2019-20 will be covered with Health Realignment. Sufficient appropriations and estimated revenues are included in the Department’s Org 5620 FY 2019-20 Adopted Budget and will be included in future budget requests through FY 2023-24.
DISCUSSION:
Fresno County has received Local Enforcement Agency (LEA) Grant Program funds since 2002. CalRecycle offers the grant to LEAs for solid waste permit and inspections programs.
To apply for grant funds, CalRecycle requires that the governing board adopt a formal resolution authorizing submittal of each one-year application. On June 3, 2014, your Board adopted a five-year resolution authorizing submittal of LEA Grant Program applications through FY 2018-19.
The first recommended action would approve a resolution authorizing submittal of the one-year applications to CalRecycle for five years, from FYs 2019-20 through 2023-24. The second recommended action would authorize the Department’s Director, or designee, to submit the grant applications and all grant related documents necessary to secure funding and implement the project, including payment requests to meet CalRecycle’s requirements. The related revenue agreements would be brought to your Board, each year, for consideration to accept one-year allocations to continue inspection and monitoring regulated solid waste facilities. A letter of designation will be submitted to CalRecycle delegating authority to execute the grant related documents the Department’s Environmental Health Division Manager.
CalRecycle has $1.5 million available statewide for FY 2019-20; the County is eligible for up to $28,358. The FY 2018-19 application would seek funding to continue supporting Solid Waste Management Enforcement Program activities, which include inspections of landfills, transfer stations, compost facilities, construction/demolition, and inert processing facilities. The FY 2018-19 grant would fund personnel costs, mandatory training, memberships, equipment, maintenance, and calibration costs of that equipment.
With your Board’s approval, the Department will submit the on-line FY 2018-19 application to meet CalRecycle’s May 23, 2019 deadline. If the application is approved, a revenue agreement would be brought to your Board for consideration to accept the one-year funds. Each year thereafter, through FY 2023-24, the Department would submit the one-year grant applications.
