SUBJECT:                     Sheriff’s Civil Automation Fund Reimbursement of Civil Division Expenses

 

RECOMMENDED ACTION(S):

TITLE

1.                     Adopt Budget Resolution increasing FY 2018-19 appropriations and estimated revenues for the Sheriff-Coroner-Public Administrator Org 3111 in the amount of $800,000 for the reimbursement of Civil Division expenses and to purchase replacement radios for the Civil Unit (4/5 vote); and

2.                     Adopt Budget resolution increasing the FY 2018-19 appropriations in the Sheriff Automated GC 26731 Org 1455 in the amount of $800,000 (4/5 vote).

REPORT

There is no increase in Net County Cost associated with these actions.  The Sheriff Automated Special Revenue Fund (SRF) is recommended for the reimbursement of expenses for the build-out and furnishing of Civil Division offices and purchase of radio equipment for the Sheriff’s Civil Unit.  The Sheriff Automated SRF may be used to purchase operating equipment for the Sheriff’s Civil Division.  This item is countywide. 

 

ALTERNATIVE ACTION(S):

 

If the recommended actions are not approved, the Sheriff’s Office will not be able reimburse expenses for the build-out and furnishing of the Sheriff’s Civil Division offices and to purchase replacement radios for the Civil Division.

 

FISCAL IMPACT:

 

There is no additional Net County Cost associated with the recommended actions; the costs will be fully offset with Civil Automation funds.  Approval of recommended action No. 1 will increase FY 2018-19 appropriations and estimated revenues in the amount of $800,000 for the Sheriff-Coroner-Public Administrator’s Org 3111 to purchase replacement radio equipment and reimburse expenses for the build-out and furnishing of the Sheriff’s Civil Division offices through an Operating Transfer In from the Sheriff Automated GC 26731 Org 1455.  Approval of recommended action No. 2 will increase the FY 2018-19 appropriations by $800,000 in the Sheriff Automated GC 26731 SRF Org 1455 using available fund balance to fund an Operating Transfer Out to the Sheriff’s Org 3111 ($800,000). 

 

DISCUSSION:

 

Pursuant to Government Code (GC) 26731, $18 of any fee collected by the Sheriff’s Civil Division under specified sections of the GC shall be deposited in a special fund in the County treasury; a separate accounting of funds deposited shall be maintained and shall be for the exclusive use of the Sheriff’s Civil Division. Government Code 26731 authorizes the Sheriff to use the Sheriff Automated SRF to supplement the costs for the implementation, maintenance, and purchase of auxiliary equipment and furnishings for automated or other non-automated operational equipment and furnishings deemed necessary by the Sheriff’s Civil Division for the Unit’s use. 

 

In July 2018, the Sheriff’s Civil Unit relocated to a separate facility to provide more efficient expanded services to the public.  The larger facility also allows the Civil Division to conduct and host training classes for law enforcement and first responder personnel from allied agencies regarding Civil laws and issues. 

 

The recommended action will appropriate the funds to purchase replacement radios for the Civil Division and reimburse expenses related to the build-out and furnishing of the Civil Division office space.
