SUBJECT:                     Board Appointment to Tranquillity Public Utility District’s Board of

                     Directors

 

RECOMMENDED ACTION(S):

TITLE

1. Consider candidate and appoint director to the Tranquillity Public Utility District Board of Directors, Gary R. Minnite term expiring in 2023.

REPORT

Approval of this action will allow your Board to appoint one director to the Tranquillity Public Utility District (“Tranquillity PUD”) Board, which is governed by the California Public Utility Code (“PUC”). This item pertains to a location in District 1.

 

ALTERNATIVE ACTION(S):

 

If the recommended action is not approved, a director position will remain vacant on the Tranquillity PUD Board.  Your Board may also call an election to fill the vacancy

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended actions.

 

DISCUSSION:

 

In accordance with California Government Code Section1780 (h), if the number of remaining members of a district board falls below a quorum, then at the request of the district secretary or a remaining member of the district board, the Board of Supervisors, as the supervising authority, shall promptly appoint a person to fill the vacancy, or may call an election to fill the vacancy.

 

On August 16, 2021, Keith Eubanks resigned from the board of the Tranquillity PUD.  The Bylaws of the Tranquillity PUD require three directors to be present to conduct district business.  The Tranquillity PUD submitted an application from Gary R. Minnite to the Clerk of the Board of Supervisors, which was received on October 25, 2021. The applicant is qualified to serve on the Tranquillity PUD Board pursuant to PUC Section 15952. The Tranquillity PUD’s three (3) member board of directors are elected to serve a staggered four-year term. If the Board of Supervisors appoints the applicant to the Tranquillity PUD’s Board, his term will expire in 2023. The Tranquillity PUD is wholly within Fresno County.
