SUBJECT: Fourth Amendment to Agreement with Toppan Merrill, LLC
RECOMMENDED ACTION(S):
TITLE
Approve and authorize the Chairman to execute a Fourth Amendment to Agreement No. 15-369 with Toppan Merrill, LLC for the procurement of County Voter Information Guides, effective upon execution with no change in term to June 30, 2021 and increasing the maximum compensation by $135,000 to a total of $4,355,000.
REPORT
Approval of the recommended action will increase the maximum compensation amount for the procurement of County Voter Information Guides to $885,000 for FY 2019-20. This additional amount is necessary due to increased governmental requirements for translation services of facsimile ballots and other election related materials, and the growth in voter registration. This item is countywide.
ALTERNATIVE ACTION(S):
There are no viable alternatives. If your Board does not approve the recommended action, the County may not be able to provide state-mandated election material for upcoming elections.
FISCAL IMPACT:
There is no increase in Net County Cost associated with the recommended action. Approval of the recommended action will increase the maximum agreement amount by $135,000, for a new maximum potential six-year total of $4,355,000. Sufficient appropriations and estimated revenues are included in the FY 2019-20 County Clerk - Elections Org 2850 Adopted Budget and will be included in subsequent requested budgets for the duration of the contract term.
DISCUSSION:
California Elections Code requires that voter specific County Voter Information Guides (CVIG) be sent to each eligible, registered voter prior to Election Day. These booklets include descriptions of contests and ballot measures, facsimiles of ballots, statements provided by candidates, impartial analysis of measures, arguments for and against measures, the actual text of each measure, voting instructions, a list of available vote centers and ballot drop boxes, and other helpful information. CVIGs are mailed to registered voters for each election 40 to 15 days prior to Election Day. There are approximately 471,000 registered voters living in Fresno County.
Approval of the recommended action will increase Agreement No. 15-369’s compensation for year number five of the Agreement, July 1, 2019 - June 30, 2020, by $135,000 to a total of $885,000. This will result in an increase of the maximum compensation agreement total from $4,220,000 to $4,355,000. This additional amount is necessary due to increased governmental requirements for translation services of facsimile ballots and other election related materials, and the growth in voter registration. All other terms and conditions of Agreement No. 15-369 will remain unchanged.
