RECOMMENDED ACTION(S):
TITLE
Approve the Amended and Restated Bylaws of the Raisin City Water District
REPORT
The Raisin City Water District by a 4/5 vote of its Board of Directors voted to amend its existing bylaws and now seeks approval from your Board of such amended bylaws as required by the State of California Water Code. Approval by your Board may be by a simple majority.

ALTERNATIVE ACTION(S):

Your Board may choose not to approve the Amended Bylaws. This will leave the District to seek approval from 2/3 of the total vote of the District either in writing or by ballot cast at a district election.

FISCAL IMPACT:

The recommended action has no fiscal impact on the County.

DISCUSSION:

The Raisin City Water District Bylaws were last updated in 1995 and are no longer in compliance with current public agency requirements. The District drafted amended bylaws that provide for regular monthly Board of Director meetings, change the location of the Board meetings to a public location, move the District office to a location accessible to the public, and update the requirements for posting and noticing meetings to comply with current regulations. The original document was drafted in 1995 and no longer exists in electronic form; therefore, a red-line version could not be provided. However, County Counsel's office did review both the original and the new amended and restated Bylaws.

In accordance with California Water Code Section 35305, bylaws may be amended, repealed or new bylaws adopted by either a 2/3 vote of its members or by 4/5 vote of its Board and approval by the Board of Supervisors of the principal county of the District.
