SUBJECT:                     Retroactive Amendment I to Agreement with the City of San Joaquin for Law                      Enforcement Services

RECOMMENDED ACTION:

TITLE

Approve and authorize Chairman to execute retroactive Amendment I to Agreement 15-371 with the City of San Joaquin to extend the term of the existing Agreement for law enforcement services by one year from July 1, 2016 to June 30, 2017 and increasing the contract maximum by $85,706 to a total of $182,566.

REPORT

There is no additional Net County Cost associated with this action, which will allow the Sheriff-Coroner to continue providing an additional thirty hours per week of patrol services and coverage of events such as football games, festivals or other activities for the City of San Joaquin.

ALTERNATIVE ACTION:

Non-approval of the recommended action will result in the loss of revenue to the Sheriff-Coroner’s Office and services to the City of San Joaquin.

RETROACTIVE AGREEMENT:

This recommended agreement is retroactive to July 1, 2016 due to a delay in obtaining approval from the City of San Joaquin which was received on June 14, 2016.

FISCAL IMPACT:

There is no increase in Net County Cost associated with this action.  The recommended agreement will provide $85,706 in revenue from the City of San Joaquin in overtime provided by a Deputy Sheriff for up to 1,560 hours at $54.94 per hour.  On May 24, your Board chose to keep the Master Schedule of Fees rate at the same level as the FY 2015-16 rates.

The Net County Cost associated with this agreement is $5,257, which represents the difference between FY 2016-17 actual costs at the overtime rate for one Deputy Sheriff ($90,963) and the costs recovered from the City of San Joaquin ($85,706) at the FY 2015-16 rate that was recommended by the Sheriff and approved by your Board as noted earlier.  The Sheriff-Coroner’s FY 2016-17 requested budget Org 3111 contains sufficient appropriations and estimated revenues for these costs.

DISCUSSION:

Since 1988, the City of San Joaquin has contracted for law enforcement services with the Fresno County Sheriff-Coroner’s Office.  While no position is assigned to the City of San Joaquin, the City has agreed to pay the Sheriff-Coroner’s Office a flat rate every month for overtime shifts to be worked in the area.  The overtime shifts will be assigned at the discretion of the Sheriff to promote public safety to the greatest extent possible with this limited level of service.

On August 11, 2015, your Board approved Agreement #15-371 to provide law enforcement services to the City of San Joaquin effective from July 1, 2015 through June 30, 2016.  The proposed amendment extends the term of the existing Agreement through June 30, 2017 and keeps the MSF at the same level as the FY 2015-16 rates as approved by your Board on May 24, 2016.  Additionally, at the request of the City of San Joaquin and upon agreement of both parties, the Sheriff-Coroner shall provide law enforcement services at special events at the FY 2016-17 Deputy Sheriff overtime rate of $54.94 per hour.
