SUBJECT:                     Agreement with the Laton Community Services District for the Laton Street Light Improvements, Community Development Block Grant (CDBG) Project No. 16411

 

RECOMMENDED ACTION:

TITLE

Approve and authorize Chairman to execute Agreement with the Laton Community Services District for the Laton Street Light Improvements, Community Development Block Grant Project No. 16411 ($250,000).

REPORT

The Agreement provides Community Development Block Grant (CDBG) funding for the Laton Street Light Improvements Project totaling $250,000.  The project is included in the County’s 2016-17 Action Plan which was approved by the Board on April 26, 2016.

 

ALTERNATIVE ACTION:

 

The Board may reject the project and proceed to amend the 2016-17 Action Plan to delete the Laton Street Light Improvements Project and direct staff to identify another project on the 2016-2017 Back Up list for consideration.  However, deletion of this project may impact the County’s ability to meet its CDBG expenditure timelines, which are set by U.S. Department of Housing and Urban Development.

 

FISCAL IMPACT:

 

There is no Net County Cost associated with the recommended action.  The total estimated project cost is $259,000.  CDBG funds for the Laton Street Light Improvements Project, in the amount of $250,000, from the County’s unincorporated area allocation are included in the Department’s Community Development Block Grant Org 7205 Adopted Budget for FY 2016-17.  CDBG funds are provided on a reimbursement basis.  The Laton Community Services District will provide all sums of money in excess of the CDBG funds that may be necessary to complete the project.

 

DISCUSSION:

 

On April 26, 2016, the Board approved the 2016-17 Unincorporated Area Projects list as part of the Annual Action Plan, which included the Laton Street Light Improvements Project.

 

The Laton Street Light Improvements Project proposes to install street lights, electrical conduit, and related improvements at various locations within the Laton Community Services District where they are either deficient or non-existent.  The project includes various locations within the District approximately bounded by Gonser, Nares, Murphy, and Latonia Avenues.  The improvements will increase safety and benefit a service area that will principally assist low to moderate income residents.

 

In addition to providing funds for the Laton Street Light Improvements Project, the Agreement requires that the Laton Community Services District prepare the plans and specifications for the project that conform with Federal and State regulations governing Federally-assisted projects.  The Agreement also provides that the District be responsible for the advertising and awarding of the project to the lowest responsible bidder and for completion of the necessary construction engineering.  The County agrees to review and approve the plans and specifications for compliance with Federal regulations prior to the District advertising of the project for bid.  The Laton Community Services District agrees to maintain the improvements after project completion.

 

Initial Study/Environmental Assessment No. 7144 was completed for the Laton Street Light Improvements Project under the provisions of the California Environmental Quality Act (CEQA) and the National Environmental Policy Act (NEPA).  Based on the environmental review, the project is categorically exempt from the provisions of the CEQA Guidelines under (Section 15301, Class 1 - Existing Facilities.  Under Section 15301, a Class 1(c) exemption consists of the operation, repair, maintenance or minor alteration of existing public facilities involving negligible or no expansion of use includes existing highways, streets, and sidewalks).  It has also been determined that the project is exempt per Section 58.34 (a)(12) of the NEPA Guidelines because the project meets the requirements for a categorical exclusion under Section 58.35 (a).

 

OTHER REVIEWING AGENCIES:

 

The Agreement has been reviewed and approved by the Laton Community Services District.
