SUBJECT:                     Adopt Ordinance 8.24.060 Prohibiting Scavenging - Pilot Program

 

RECOMMENDED ACTION(S):

TITLE

Conduct Second Hearing and Adopt Ordinance Prohibiting Scavenging adding new Section 8.24.060 to Chapter 8.24 Waste Disposal of Title 8 of the Fresno County Ordinance Code and waive further reading of the Ordinance in its entirety.

REPORT

With Board approval, upon the completion of the second hearing, the Ordinance will be in effect for one-year.  The pilot-program will be re-evaluated at the end of 12 months to identify the usefulness and sustainability of the Ordinance. 

 

ALTERNATIVE ACTION(S):

 

The Board of Supervisors may decline to adopt the Ordinance that allows for the initiation of a one-year pilot program prohibiting scavenging.

 

FISCAL IMPACT:

 

Fig Garden Policing District will assume costs associated with enforcement of the pilot program.

 

DISCUSSION:

 

On September 13, 2016, the Board conducted the first hearing and approved the initiation of the pilot program prohibiting scavenging in the Fig Garden Policing District.

 

The Ordinance has been revised to reflect the fines of the infraction to be $100 for the first violation, $200 for the second violation and $300 for the third violation and each additional violation within a 12 month period as directed by the Board on September 13, 2016.

 

By state statute, fines for infractions are limited to $100 for first, $200 for second and $500 for third violations in 12 month period.
