SUBJECT:                     Amendment IV to Revenue Agreement with the California Department of Public Health

 

RECOMMENDED ACTION(S):

TITLE

Approve and authorize the Chairman to execute Amendment IV to revenue Agreement No. 14-602 and related California Civil Rights Laws Attachment form with the California Department of Public Health, for Federal and State Public Health Emergency Preparedness and Hospital Preparedness Program funds extending the term one year from July 1, 2017 through June 30, 2018 and increasing the maximum by $72,159 to a total of $4,657,699.

REPORT

In order to fund other California Department of Public Health (CDPH) priorities, the Public Health Emergency Preparedness (PHEP) Base and PHEP Cities Readiness Initiative (CRI) funding statewide were reduced in FY 2016-17.  The proposed amendment restores the reduced funding and extends the overall term of the agreement from three years to four years, allowing funds to be spent in FY 2017-18.  The funds support the public health and hospital preparedness program emergency response to bioterrorism, outbreaks of infectious disease, and other public health threats and emergencies through the Department of Public Health, with no Net County Cost.

 

ALTERNATIVE ACTION(S):

 

There is no alternative action.  Should your Board not approve the recommended action, the Department would not be able to receive the additional PHEP Base and CRI funds and would not be able to utilize FY 2016-17 funding after June 30, 2017.

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended actions.  The proposed revenue amendment increases the PHEP Base funding by $82,396 and CRI funding by $19,763 in FY 2017-18 and reduces PHEP Lab funding by $30,000, previously allocated for a lab trainee position that remained unfilled because of the public health lab construction.  The overall net increase ($72,159) will be allocated to FY 2016-17 and 2017-18, increasing the contract maximum from $4,585,540 to $4,657,699.

The one-year extension allows FY 2016-17 funds to be utilized for an additional year, through June 30, 2018.  Sufficient appropriations and estimated revenues are included in the Department’s Org 5620 FY 2016-17 Adopted Budget and will be included in the FY 2017-18 budget request.  The recommended amendment allows full recovery of direct costs, but limits indirect cost recovery to 14.7%, the amount necessary to cover the related Department costs ($245,263).  The grant allocation is non-competitive and does not require matching funds.

 

DISCUSSION:

 

On September 30, 2014, your Board approved Agreement No. 14-602 with CDPH for public health and emergency preparedness response activities.  Throughout the term of the agreement, amendments one through three adjusted the compensation amount.  The recommended amendment:

 

                     restores compensation that was reduced in amendment three increasing the maximum compensation amount;

                     allows for a one-year extension to expend unspent FY 2016-17 funds in FY 2017-18; and,

                     reduces PHEP Lab funding intended to fund an unfilled lab trainee position, as hiring was delayed due to ongoing public health lab construction activities in FY 2016-17.

 

PHEP funds are utilized to develop and refine written plans and operating procedures that support regional public health emergency preparedness and response including trainings, drills, exercises, community outreach, reports, and corrective action plans.  Response activities include addressing pandemic flu epidemics and other contagious diseases, alternate care sites, biological incidents, and advance laboratory services.  The Hospital Preparedness Program maintains and enhances local hospital, clinic, and long-term health care facility all-hazards event capabilities.

 

The increased PHEP Base and CRI funds will be used for the following activities:

 

                     work with a local mosquito abatement district to provide Zika Virus Disease and other mosquito borne illness outreach and education activities; and,

                     recruit businesses and other organizations which would assist the County in providing prophylaxis medication to their employees/clientele during certain types of public health events.

 

The California Civil Rights Attachment provides assurance that the contractor certifies compliance with the Unruh Civil Rights Act (Section 51 of the Civil Code) and the Fair Employment and Housing Act (Section 12960 of the Government Code).  The Unruh Civil Rights Act is legislation that provides all persons within the jurisdiction of this State are free and equal, no matter what their sex, race, color, religion, ancestry, national origin, disability, medical condition, genetic information, marital status, or sexual orientation are entitled to the full and equal accommodations, advantages, facilities, privileges, or services in all business establishments of every kind whatsoever.  All other terms and conditions of the agreement remain unchanged.
