SUBJECT: Workforce Innovation and Opportunity Act Mandated Partner Memorandum of Understanding
RECOMMENDED ACTION(S):
TITLE
1. Approve and authorize the Chairman to execute Retroactive Memorandum of Understanding (MOU) between the Fresno Regional Workforce Development Board (FRWDB) and the California Indian Manpower Consortium effective July 1, 2016 to June 30, 2019 ($0).
2. Approve and authorize the Chairman to execute Retroactive Memorandum of Understanding (MOU) between the Fresno Regional Workforce Development Board (FRWDB) and the National Council on Aging effective February 1, 2017 to June 30, 2019 ($0).
REPORT
On February 2, 2016, your Board approved the use of the Workforce Innovation and Opportunity Act (WIOA) Mandated Partner Memorandum of Understanding (MOU) template. Approval of the recommended action will authorize execution of an MOU with the California Indian Manpower Consortium and the National Council on Aging.
ALTERNATIVE ACTION(S):
There is no alternative action. If this item is not approved, Fresno County will be out of compliance with WIOA requirements and could lose funding for WIOA activities that benefit the residents of Fresno County.
RETROACTIVE AGREEMENT:
The recommended MOU with the California Manpower Consortium is retroactive to July 1, 2016 as it took the California Indian Manpower Consortium one year to provide full signoff on the agreement. The MOU also needs to coincide with other mandated partner MOUs. The recommended MOU with the National Council on Aging is retroactive to February 1, 2017 as the Council start date is based on the date they took over the Older American partnership from AARP.
FISCAL IMPACT:
There is no increase in Net County Cost associated with the recommended action. The FRWDB is 100% funded by non-County sources. These have their origin primarily with the United States Department of Labor, being supplemented by other federal and State of California grants.
DISCUSSION:
The WIOA mandates that certain Federal, State, and local agencies formally partner with local Workforce Development Boards at what is now known as America’s Jobs Centers of California (AJCC), in order to refer clients between the partners for specific services to better serve the community and leverage resources from multiple sources, as appropriate.
The MOUs are required to be signed by the Chief Local Elected Officials (County of Fresno and the City of Fresno) and submitted to the California Employment Development Department’s Workforce Services Division.
The Board at its meeting on February 2, 2016 approved a previous version of the template. The template has been updated to incorporate mandated elements not known prior to that meeting.
The mandated updates were:
• Added new Section I - Vision and Mission
• Added new Section VI - The Customers To Be Served
• Added new Section VII - Americans With Disabilities Act Compliance
• Added new Section XXI - Shared Information and System Security
• Added new Section XXII - Public Communications and Branding Related to WIO Services
Your Board utilizing the updated template has approved the following MOUs:
• June 21, 2016; MOU with the Department of Social Services
• August 9, 2016: MOU with the State of California Employment Development Department, Department of Rehabilitation, AARP Foundation, Fresno Economic Opportunities Commission, Proteus, Inc., Job Corps, State Center Adult Education Consortium, and West Hills Adult Education Consortium
• September 13, 2016: MOU with the West Hills Community College District
Approval of the first recommended action will authorize execution of a MOU with the California Indian Manpower Consortium.
Every five (5) years, the United States Department of Labor (USDOL) procures providers for the Senior Community Service Employment Program (Title 5, Older Americans Act).
On February 1, 2017, the National Council on Aging was selected by the USDOL to replace the AARP Foundation to carry out the Senior Community Service Employment Program in Fresno County.
The Board at its meeting on July 25, 2016 approved the Partner MOU between the FRWDB and the AARP Foundation.
Approval of the second recommended action formalizes the mandated partnership between the FRWDB and the National Council on Aging.
