SUBJECT: Property Assessed Clean Energy Program
RECOMMENDED ACTION(S):
TITLE
1. Adopt Resolution consenting to the inclusion of properties within the unincorporated territory of the County in the California Statewide Communities Development Authority Open PACE program.
2. Authorize the Chairman to execute the First Amendment to Agreement for the Collection of Special Assessments.
REPORT
Adoption of this resolution will allow additional programs operating under the California Statewide Communities Development Authority (CSCDA) Open PACE program to offer services to property owners within the unincorporated territory of the County. Property Assessed Clean Energy (PACE) programs are a means for property owners to implement energy savings projects utilizing voluntary contractual assessments placed on their property tax bills. The second recommended action will amend the agreement between the County and CSCDA for the recovery of County costs associated with the programs.
ALTERNATIVE ACTION(S):
Your Board may deny the request to allow these programs to operate within the unincorporated territory of the County.
FISCAL IMPACT:
There is no Net County Cost associated with this action. Costs associated with placing the voluntary contractual assessments on property tax bills and the collection and disbursement of those receipts will be reimbursed by CSCDA, per the Amendment to Agreement 15-105 between the County and CSCDA.
DISCUSSION:
On March 24, 2015, the Board authorized participation in the CaliforniaFIRST program established by CSCDA, a joint powers authority of which the County is a member. CSCDA has approached the County asking that additional programs be authorized under its authority to operate within the unincorporated areas of the County. The recommended resolution will add four additional CSCDA programs, AllianceNRG Program, PACE Funding LLC, CleanFund Commercial PACE Capital and Spruce Finance, to those currently offered to property owners. Other programs currently authorized include the HERO program (August 19, 2014), CaliforniaFIRST (March 24, 2015), Ygrene Energy Fund CA LLC (March 1, 2016) and CMFA Open PACE (August 23, 2016).
The second recommended action will amend the current agreement with CSCDA to allow for the County to recover its costs associated with the PACE programs. The current agreement related only to the CaliforniaFIRST program.
