SUBJECT:                     Revenue Agreement with Public Health Foundation Enterprises for Zika Response Resources

 

RECOMMENDED ACTION(S):

TITLE

Approve and authorize the Chairman to execute a revenue Agreement with Public Health Foundation Enterprises, Inc. for Zika Response Resources, effective upon execution through July 31, 2018 ($163,676).

REPORT

Public Health Foundation Enterprises, Inc. (PHFE) on behalf of the California Department of Public Health (CDPH) received a funding award from the U.S. Centers for Disease Control and Prevention (CDC) to enhance State and Local Health Department (LHD) response to Zika Virus Disease (ZVD), targeted for epidemiology and surveillance, laboratory, and ZVD registry activities.  Approval of the recommended action will fund response activities in the County, with no Net County Cost.

 

ALTERNATIVE ACTION(S):

 

Should your Board not approve the recommended actions, the Department would not be able to fund the ZVD response activities identified in the recommended agreement through July 31, 2018.

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended action.  The PHFE grant will provide $163,676 through July 31, 2017.  Although the recommended agreement would be effective upon execution, no funds will be expended during FY 2016-17.  Sufficient appropriations and estimated revenues will be included in the FY 2017-18 Requested Budget and in subsequent budgets for the terms duration.  The recommended agreement allows for full recovery of direct costs, but limits indirect cost recovery to 15%.  The grant allocation does not require matching funds.

 

DISCUSSION:

 

Since the rapid spread of ZVD throughout the Americas began gaining significant attention in 2015, the CDC and CDPH began providing support to local jurisdictions to minimize exposure and respond to confirmed cases.  As part of this ongoing effort, PHFE, on behalf of the CDPH, has been awarded funding from the CDC to enhance State and Local Health Department response to ZVD targeted to epidemiology and surveillance, laboratory, and registry activities.

 

On February 2, 2017, the Department was made aware of the PHFE Zika Response Resources grant.  The grant application, seeking $183,226 in funding, was submitted on February 16, 2017.  Your Board approved the retroactive grant application submittal on April 25, 2017.  The grant award, $163,676, is $19,550 less than the amount requested in the application.

 

The recommended agreement proposes using grant funds to conduct five primary activities:

 

1.                     Conduct ZVD registry activities;

2.                     Develop a mosquito abatement spreadsheet to communicate ZVD cases more efficiently to the local Mosquito Abatement Districts (MADs);

3.                     Conduct epidemiology evaluation of ZVD data

4.                     Develop ZVD education materials for pregnant females, including print materials, television, radio, digital platforms, and community outreach events

5.                     Offer general ZVD outreach services including print materials, television, radio, digital platforms, and community outreach events

 

The recommended agreement is a standard form used by PHFE as it contracts with multiple counties throughout the State for ZVD Response Resources and identifies the term as beginning March 1, 2017.  Although the recommended agreement would be effective upon execution, the Department will not expend funds until after the beginning of the FY 2017-18. 

 

The recommended agreement contains an indemnification clause whereby the County indemnifies PHFE.  PHFE can terminate the recommended agreement without cause at any time upon providing the County 15-day advanced written notice.  PHFE and the County may immediately terminate the recommended agreement for reasonable cause, as defined in the recommended agreement.  The recommended agreement requires the County to maintain specific minimum insurance coverage amounts, but does not require PHFE to maintain specific insurance amounts. Additionally, Los Angeles County is identified as the venue for enforcement of any portions of the recommended agreement.
