SUBJECT:                     Amendments to Agreements with California State University, Fresno Foundation and Public Health Institute

 

RECOMMENDED ACTION(S):

TITLE

1.                     Approve and authorize the Chairman to execute Amendment II to Agreement No. 15-323 with California State University, Fresno Foundation to reduce the term of the existing Agreement for program evaluation services by one year to September 29, 2017 and decrease the maximum by $273,967 to $258,621.

 

2.                     Approve and authorize the Chairman to execute retroactive Amendment I to Agreement No. 15-548 with Public Health Institute to reduce the term for public health community engagement services by one year and two months to July 31, 2017 and decrease the maximum by $1,635,863 to $1,670,684.

REPORT

Approval of the recommended actions will amend agreements with California State University, Fresno Foundation (CSUF Foundation) and Public Health Institute (PHI) to adjust for funding decreases by the Centers for Disease Control and Prevention (CDC) to the Partnerships to Improve Community Health (PICH) grant program. The CDC significantly reduced the County’s Federal FY 16-17 funding and will no longer allow the option to extend the project period term using prior year unspent funds.  Additionally, the recommended retroactive PHI amendment corrects a prior year’s overstatement.

 

ALTERNATIVE ACTION(S):

 

There is no viable alternative action. Should your Board not approve the recommended actions, the Department may be required to compensate the CSUF Foundation and PHI more than the County would be able to recover from the CDC PICH grant.

 

RETROACTIVE AGREEMENT:

 

The recommended Amendment I to PHI’s agreement is retroactive to November 1, 2015, to correct an overstatement in maximum compensation in Year One.

 

FISCAL IMPACT:

 

There is no increase to Net County Cost associated with the recommended actions. The proposed amendment to the agreement with the CSUF Foundation will reduce the maximum compensation from $532,588 to $258,621, a 51% decrease ($273,967). CSUF Foundation’s annual allocations will be as follows:

 

                     Year One (7/14/15 - 9/29/16): $175,121

                     Year Two (9/30/16 - 9/29/17): $83,500 (reduced by $88,950; 52%)

                     Year Three (9/30/17 - 9/29/18): $0 (reduced by $185,017; 100%)

 

The proposed amendment to the agreement with PHI will reduce the maximum compensation from $3,306,547 to $1,670,684, a 49% decrease ($1,635,863). It will also correct an overstatement of available funding to the Year One budget. PHI’s annual allocations are as follows:

 

                     Year One (11/1/15 - 9/29/16): $1,329,489 (reduced by $467,154; 26%)

                     Year Two (9/30/16 - 7/31/17): $341,195 (reduced by $968,830; 74%)

                     Year Three (9/30/17 - 9/29/18): $0 (reduced by $199,879; 100%)

 

Sufficient appropriations are included in the Department of Public Health’s Org 5620 FY 2016-17  Adopted Budget and will be included in the Org 5620 FY 2017-18 Requested Budget.

 

DISCUSSION:

 

Your Board approved Agreement No. 15-323 with CSUF Foundation on July 14, 2015 and Agreement No. 15-548 with PHI on October 27, 2015 to implement approved activities under the PICH grant program that create opportunities for County residents to make healthy choices and improve health outcomes. The recommended amendments will allow the Department to respond to a decrease in funding provided by the CDC.

 

The Department received the PICH Notice of Award from CDC on September 17, 2014, with funding projected to remain stable at $1,585,154 per grant year (9/30/14 - 9/29/17), based on availability of funds and satisfactory progress. However, in a revised Notice of Award received on August 25, 2016, the Department’s Year Three funding was decreased to $569,747 due to non-allocation of funds at the Federal level. On September 14, 2016, the Department instructed CSUF Foundation and PHI to submit and adhere to revised budgets reflecting the decrease; both contractors are currently operating according to the proposed reductions.

 

PHI is responsible for implementing scope of work activities, including increasing access to:

 

                     tobacco-free environments through reduced retail storefront advertising;

                     healthy food options for residents with low access to grocery stores; and,

                     preventative health services through increased health plan coverage of lifestyle intervention programs and improved community-clinical linkages.

 

CSUF Foundation, through its Central Valley Health Policy Institute, is the program evaluator, responsible for:

 

                     designing appropriate outcome evaluation methodologies, protocols, and instruments;

                     data collection, entry and analysis; and,

                     reporting and disseminating results and findings.

 

The recommended amendments will remove auto-renewal language that was included with the anticipation of extending the project period using previously allocated grant funds to complete remaining approved scope of work activities. The no-cost extension is no longer an option due to the unavailability of grant funds.

 

The recommended amendment with PHI will revise the Year One budget to account for an overstatement of available funds. The revised total reflects PHI’s actual expenditures during that budget period.  All other terms and conditions remain unchanged.
