RECOMMENDED ACTION(S):

TITLE

1.                     Approve and authorize the Chairman to execute an Agreement with Turning Point of Central California, Inc. for specialty mental health and substance use disorder outpatient treatment services as set forth in Assembly Bill 109: 2011 Public Safety Realignment, effective July 1, 2017, not to exceed five consecutive years, which includes a three-year base contract and two optional one-year extensions, total not to exceed $13,624,905.

 

2.                     Approve and authorize the Chairman to execute an Agreement with Turning Point of Central California, Inc. for Full Service Partnership services as set forth in Assembly Bill 109: 2011 Public Safety Realignment, effective July 1, 2017, not to exceed five consecutive years, which includes a three-year base contract and two optional one-year extensions, total not to exceed $7,779,515.

REPORT

Approval of the recommended actions will allow the Department of Behavioral Health to provide specialty mental health and substance use disorder outpatient treatment (Outpatient) and Full Service Partnership (FSP) services through Turning Point of Central California, Inc. (Turning Point). The services target adult prison population transfers, per Assembly Bill (AB) 109: 2011 Public Safety Realignment (Chapter 15, Statutes of 2011). The services are funded with Mental Health Realignment, Mental Health Services Act - Community Services and Support (MHSA - CSS), 2011 Public Safety Realignment, Substance Abuse Prevention and Treatment (SAPT) Block Grant, Drug Medi-Cal and Short-Doyle/Medi-Cal Federal Financial Participation (FFP) monies, with no increase in Net County Cost.

 

ALTERNATIVE ACTION(S):

 

There are no viable alternative actions. If your Board does not approve the recommended actions, current services for the AB 109 population will be discontinued.

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended actions. The maximum cost of the recommended agreements is as follows:

 

                     Substance Use Disorders and Outpatient Mental Health for $13,624,905; and,

                     Full Service Partnership for $7,779,515.

Sufficient appropriations and estimated revenues will be included in the Department’s Org 5630 FY 2017-18 Recommended Budget and in subsequent budget requests for the duration of the terms.

 

The recommended administrative costs for FY 2017-18 are at 8% for Outpatient and 13% for FSP as compared to the total budget, and at 8% and 13%, respectively, as compared to the total budget for the remaining fiscal years 2018-19 through 2021-2022. The recommended employee benefits costs for each FY are at 41% for Outpatient and 36% for FSP as compared to the total salaries. The benefits calculation includes the full amount of employee health and retirement costs, life insurance, payroll taxes, State disability and unemployment insurance. Based on similar contract services, the percentages are both reasonable and necessary for the administration of the program.

 

DISCUSSION:

 

The Fresno County Community Corrections Partnership (CCP) AB 109 Implementation Plan (Plan) was established in 2011 and is in its fourth update. The Plan implemented the Post-Release Community Supervision (PRCS) Act of 2011, pursuant to California Penal Code, section 3450, and now includes the following approved services for adult prison population transfers:

 

                     Outpatient substance use disorder and specialty mental health services;

                     FSP for specialty mental health services to seriously mentally ill individuals including transfers under County Probation Department (Probation) supervision, 24 hours a day, 7 days a week with telephone and face-to-face contact, as needed;

                     Intensive residential treatment beds;

                     Outpatient pre-trial services for transfers under Probation supervision and awaiting trial; and,

                     Contracted service provider access to the Department’s integrated mental health information system.

 

On April 24, 2012, your Board approved Agreement No. 12-184 with Turning Point for Outpatient and substance use disorder treatment services and Full Service Partnership mental health services to adult population transfers as set forth in AB 109. On February 1, 2017, the CCP Executive Committee approved the Department’s request for AB 109 funding to continue substance use disorder and/or mental health treatment outpatient and FSP services for up to five additional fiscal years.

 

On March 9, 2017, the Department issued Request for Proposal (RFP) No. 17-064 for Outpatient Mental Health/Substance Use Disorder Services and Full Service Partnership Services for AB 109 clients. The RFP required prospective bidders to describe comprehensive substance use disorder and mental health service delivery with an emphasis on evidence-based models of care to meet the unique needs of the target population with preference given to bidders who could provide both services.

 

The Department received proposals from three agencies, with all three bidding on both services. A review committee comprised of staff from the Department, a community member, and a Probation staff member. All proposals were ranked according to Internal Services Department - Purchasing Division guidelines based on a combination of proposal content, quality of proposed services, and experience in delivering treatment services to the target population. The committee came to a consensus and recommended awarding services to Turning Point, selected due to: a complete and responsive proposal, demonstrated knowledge and experience working with the AB 109 client population, demonstrated experience collaborating with Probation, and an effective and comprehensive cost proposal.

 

Upon approval by your Board, the two recommended agreements will provide Outpatient and FSP services for more effective monitoring in accordance with State Department of Health Care Services (DHCS) and County Department of Behavioral Health requirements. The recommended agreements provide for termination due to non-allocation of funds upon giving 30-days advance written notice to the contractor and provides for termination without cause by the contractor, the County, or the Department Director, or designee, upon giving 60-days advance written notice to terminate.
