SUBJECT:                     Retroactive Penal Code 290 Satellite Jail Facility Shared Use Agreement

                     with the City of Fresno

 

RECOMMENDED ACTION(S):

TITLE

Approve and authorize Chairman to execute a retroactive Agreement with the City of Fresno for the shared use of the Satellite Jail Facility office area effective July 1, 2015 through June 30, 2020, which includes a three-year base contract and two optional one-year extensions, total not to exceed $100,000.

REPORT

The recommended action will allow the County of Fresno through the Sheriff-Coroner’s office (FSO) and the City of Fresno through the Fresno Police Department (FPD) to enter into an agreement to continue the consolidated services for the identification, registration, and monitoring of subjects regulated under the provisions of California Penal Code (PC) Section 290 (Sex Crime Registrants).  The County agrees to share the use of the office area of the Satellite Jail during the term of the agreement.  The County and City will share in the ongoing costs of the facility with the City paying $20,000 per year.

 

ALTERNATIVE ACTION(S):

 

Your Board may choose not to approve the recommended action thereby impacting the consolidated effort to continue these services for the monitoring of Sex Crime Registrants in the County of Fresno and City of Fresno.

 

RETROACTIVE AGREEMENT:

 

Approval of the recommended action will make the agreement with the City of Fresno effective July 1, 2015.  This agreement is retroactive due to staff oversight and lengthy contract negotiations.  The Sheriff-Coroner’s Office received the signed Agreement from the City of Fresno on June 1, 2017.  The Sheriff-Coroner’s Office is bringing it to your Board on the first available Board date within agenda item processing timelines.

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended action.  All on-going costs of the operation will be proportionately shared between the FSO and the FPD.  These costs will be paid by the FSO with an equally proportional reimbursement invoiced to the FPD each quarter.  The City’s anticipated shared of costs for this operation is estimated at approximately $20,000 per year.  These costs are included in the Sheriff-Coroner’s Org 3111 FY 2017-18 recommended budget.  The Sheriff-Coroner’s FY 2015-16 and FY 2016-17 adopted budgets included enough appropriations to pay for the estimated costs.

 

During the pilot project agreement the on-going costs were proportionally shared between the Sheriff-Coroner’s Office (31.2%) and the FPD (68.8%).  These percentages were calculated based on the square footage that was being utilized by each agency.  These costs included PG&E, water, garbage, telephone, janitorial, pest control, alarm monitoring, etc.    During the proposed contract term, costs for these expenses will be invoiced to the FPD at the rate of $5,000 per quarter, $20,000 per year.  The change from a percentage to a fixed amount is based on an update of the space utilization of the Satellite Jail.

 

The City of Fresno has already paid the County of Fresno a total of $54,850 for use of the Premises since July 1, 2015, for which credit will be applied under the new agreement, if the recommended action is approved.  As a result, the City of Fresno has already paid costs for FY 2015-16 ($20,000) and FY 2016-17 ($20,000).  The difference of $14,850 will be applied to FY 2017-18 costs of $20,000, leaving a balance of $5,150 to be paid in the current year.

 

DISCUSSION:

 

The FSO and the FPD continue to explore ways to become more effective and more efficient in the delivery of public safety services.  Many similar operations have been consolidated between the two agencies in the past, such as Narcotics Enforcement and High Intensity Drug Trafficking Area (HIDTA), Gang Enforcement (MAGEC), Warrants, Transportation and Extraditions, Urban Area Security Initiative grants, Mounted Units, etc.

 

On May 18, 2010, your Board approved via a pilot project an agreement with the City of Fresno to consolidate the processing of Sex Crime registrants.  This pilot project agreement was effective for an initial term of one year with four additional one-year extensions.

 

Under the pilot project agreement both agencies, with regards to Sex Crime Registrants, consolidated and relocated all current investigators from their headquarters facilities into the underutilized office area of the Satellite Jail.  This action eliminated sex offenders from coming into the lobby areas of both agencies’ headquarters buildings and mingling with citizens there on unrelated business such as obtaining copies of reports, getting vehicles releases, processing civil papers etc.  Instead of renting another building in the downtown area for this purpose, both agencies have been using the Satellite Jail.  Access to the Satellite Jail is available via automotive or public transportation, and many of the registrants already are aware of the location of this facility.

 

Due to an oversight from both FSO and FPD this agreement continued beyond the pilot project term, with FPD continuing to make payments to FSO. Once this oversight was recognized, FSO and FPD began negotiating a new agreement.  Due to lengthy contract negotiations and the oversight, FSO is bringing this agreement to your Board on the first available Board date within the agenda item processing timelines.

 

It should be noted the agreement provides that the Sheriff-Coroner or the Chief of Police may extend the agreement for up to two one-year periods or exercise the 30-day contract termination option on behalf of the County or City of Fresno, respectively.

 

Additionally, the FSO and FPD are continuing to evaluate the feasibility of the Sheriff-Coroner’s Office Jail Identification Section handling FPD’s entire arrestee processing (prisoner processing).  If feasible and approved by both agencies, a similar proposed contract would be brought to your Board for consideration to enter into an agreement with FPD to reimburse the County for additional staffing required to handle this purpose, within the existing confines of the Fresno County jail system.
