SUBJECT:                     Without Cause Termination of Four Agreements with King of Kings Community Center

 

RECOMMENDED ACTION(S):

TITLE

Approve the voluntary Without Cause termination of Agreement Nos. 16-360, 16-361, 16-295, and 15-300 with King of Kings Community Center for outpatient and residential substance use disorder treatment services and Sober Living Housing, effective July 11, 2017.

REPORT

Approval of the recommended action will allow the voluntary without cause termination of four agreements with King of Kings Community Center (King of Kings). Pending your Board’s approval, on June 22, 2017 the Department of Behavioral Health Director received and accepted the King of Kings request to voluntarily terminate on July 11, 2017.  The termination will not affect service delivery, as consumers will be transferred to other providers.

 

ALTERNATIVE ACTION(S):

 

There is no viable alternative action. 

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended action.  King of Kings was included as a vendor in four Master Agreements whose terms and compensation amounts will remain unchanged.

 

DISCUSSION:

 

King of Kings is a contracted provider under Master Agreement Nos. 16-360, 16-361, 16-295, and 15-300 for outpatient and residential substance use disorder treatment services and Sober Living Housing. 

 

On May 16, 2017, the Department Director requested your Board’s consideration and approval to terminate the four agreements with King of Kings pursuant to the Without Cause Termination clause.  During the discussion, members of the public addressed your Board in support of the King of Kings agreements.  Following discussion, your Board directed the Department to continue to work with King of Kings as a service provider pursuant to the terms stated in the existing agreements.  Further, your Board directed staff to report to your Board within 60 days on whether additional action was required. 

 

On May 18, 2017, Department staff met with the King of Kings leadership team to establish a plan to bring King of Kings into compliance with the terms stated in the agreements.  The following issues were discussed during the meeting:

 

                     communication with King of Kings leadership;

                     site reviews and feedback;

                     King of Kings Board and staff training on contractual and regulatory requirements;

                     technical assistance needs; and,

                     follow-up reviews.

 

Department staff began to provide training and technical assistance the week of May 22, 2017.  Department staff also conducted site reviews at each King of Kings treatment and the Sober Living Housing site.  Training and technical assistance continued through June 16, 2017, after which the King of Kings leadership decided to request a without cause termination.  On June 22, 2017, pending your Board’s approval, the Department Director, following consultation with County Counsel, accepted the provider’s request to terminate without cause effective July 11, 2017.

 

Approval of the recommended action will allow for the termination of the four King of Kings agreements for substance use disorder outpatient and residential treatment services and Sober Living Housing pursuant to the Termination - Without Cause clause of the agreements.
