SUBJECT:                     Reimbursement Agreement with the Fresno County Retirement Association

 

RECOMMENDED ACTION(S):

TITLE

Approve and authorize the Chairman to execute a reimbursement agreement with the Fresno County Retirement Association (FCERA) regarding Board of Retirement Elections effective September 26, 2017 not to exceed eight consecutive years, which includes a six-year base contract and two automatic one-year extensions.

REPORT

On December 8, 2015, the Fresno County Board of Supervisors approved updated election procedures for the Fresno County Employees’ Retirement Association Board of Retirement Elections.  The reimbursement agreement memorializes the reimbursement process stated in the updated election procedures.

 

ALTERNATIVE ACTION(S):

 

There is no viable alternative action under the present circumstances.  The updated election procedures, approved by the Board of Supervisors on December 8, 2015 require an agreement memorializing the reimbursement process.

 

FISCAL IMPACT:

 

There is no additional net County Cost associated with the recommended action.  FCERA will reimburse the Fresno County Clerk/Registrar of Voters for all Board of Retirement election-related costs within 45 calendar days of each Board of Retirement election.

 

DISCUSSION:

 

The Board of Retirement Election Procedures were updated and approved by the Board of Retirement on October 7, 2015 and approved by the Board of Supervisors on December 8, 2015.  The December 8, 2015 agenda item stated a reimbursement agreement would be developed between FCERA and the County memorializing the reimbursement terms and conditions for FCERA to reimburse the Fresno County Clerk/Registrar of Voters for all Retirement Board election-related costs.  The recommended reimbursement agreement provides those terms and conditions for such reimbursement.

 

The recommended reimbursement agreement, if approved by the parties, would commence  September 26, 2017 and continue until September 25, 2023; it would automatically renew for two successive one-year terms. But either party may terminate the reimbursement agreement at any time upon at least 90 calendar days’ notice, except under certain timing circumstances for Board of Retirement elections (e.g., not during a 90 calendar day period before a scheduled Board of Retirement election).

 

The recommended reimbursement agreement does not alter or amend any of the parties’ respective rights or obligations under the Board of Retirement Election Procedures or the County Employees’ Retirement Law of 1937, which is the governing law for the County’s retirement system.

 

OTHER REVIEWING AGENCIES:

 

The Retirement Administrator of the Fresno County Employees Retirement Association reviewed this item prior to the Board of Retirement’s approval and execution of the reimbursement agreement on September 6, 2017.
