SUBJECT: Ordinance Prohibiting Scavenging - Pilot Program
RECOMMENDED ACTION(S):
TITLE
1. Conduct First Hearing of an Ordinance Adding Section 8.24.060 to the Ordinance Code of the County of Fresno to Prohibit Scavenging in the Fig Garden Policing District for a time period of one year; waive reading of Ordinance in its entirety; and set second hearing for October 31, 2017.
2. Designate County Counsel to prepare a fair and adequate summary of the proposed ordinance.
3. Direct the Clerk to the Board to post and publish the required summary in accordance with Government Code Section 25124(b)(1).
REPORT
ALTERNATIVE ACTION(S):
The Board of Supervisors could modify or decline to adopt the one-year extension of the pilot program.
FISCAL IMPACT:
There is no Net County Cost associated with the recommended action. Fig Garden Policing District will all assume costs associated with enforcement of the pilot program.
DISCUSSION:
On September 27, 2016, the Board adopted Ordinance 16-015 Prohibiting Scavenging adding Section 8.24.060 to Chapter 8.24 Waste Disposal of the Title 8 of the Fresno County Ordinance Code.
The pilot program, which addresses areas within the Fig Garden Policing District (See Exhibit "A"), has been successful in deterring scavenging and providing enforcement personnel with tools needed to implement the Ordinance, including the ability to issue citations where appropriate. The reenactment of the Ordinance will allow law enforcement an additional year to identify the effectiveness of the program and the staffing demands for potential implementation in other unincorporated areas of Fresno County. Determining the reduction of nuisance, property and identify theft crimes are key elements to the success of the program.
Both Sheriff Mims and the Fig Garden Homeowners support the extension of the pilot program.
