SUBJECT:                     Agreement with the Caruthers Community Services District for the Caruthers Water Valve Replacement, Community Development Block Grant (CDBG) Project No. 17111

 

RECOMMENDED ACTION:

TITLE

Approve and authorize Chairman to execute Agreement with the Caruthers Community Services District for the Caruthers Water Valve Replacement, Community Development Block Grant Project No. 17111 ($250,000).

REPORT

The Agreement provides Community Development Block Grant (CDBG) funding for the Caruthers Water Valve Replacement Project totaling $250,000.  The project is included in the County’s 2017-18 Action Plan which was approved by the Board on August 8, 2017.

 

ALTERNATIVE ACTION:

 

The Board may reject the project and proceed to amend the 2017-18 Action Plan to delete the Caruthers Water Valve Replacement Project and direct staff to identify another project on the 2017-18 Back Up list for consideration.  However, deletion of this project may impact the County’s ability to meet its CDBG expenditure timelines, which are set by the U.S. Department of Housing and Urban Development.

 

FISCAL IMPACT:

 

There is no Net County Cost associated with the recommended action.  The total estimated project cost is $250,000.  CDBG funds in the amount of $250,000 from the County’s unincorporated area allocation are included in the Public Works and Planning - Community Development Block Grant Org 7205 FY 2017-18 Adopted Budget, for the Caruthers Water Valve Replacement Project.  CDBG funds are provided on a reimbursement basis.  The Caruthers Community Services District will provide all sums of money in excess of the CDBG funds that may be necessary to complete the project.

 

DISCUSSION:

 

On August 8, 2017, the Board approved the 2017-18 Unincorporated Area Projects list as part of the Annual Action Plan, which included the Caruthers Water Valve Replacement Project on the Back Up list should funding become available.  Due to year-end cost savings from other CDBG activities, there are now sufficient funds for this project.

 

The Caruthers Water Valve Replacement consists of the replacement of up to sixteen water valves at various locations throughout the Caruthers Community Services District.  The improvements will satisfy the requirements of the Regional Water Quality Control Board, improve water pressure and fire flows, and prevent contamination of the water system.

 

In addition to providing funds for the Caruthers Water Valve Replacement Project, the Agreement requires that the Caruthers Community Services District prepare the plans and specifications for the project that conform with Federal and State regulations governing Federally-assisted projects.  The Agreement also provides that the District be responsible for the advertising and awarding of the project to the lowest responsible bidder and for completion of the necessary construction engineering.  The County agrees to review and approve the plans and specifications for compliance with Federal regulations prior to the District advertising of the project for bid.  The Caruthers Community Services District agrees to maintain the improvements after project completion.

 

Initial Study/Environmental Assessment No. 7022 was completed for the Caruthers Monitoring Well and Water Valve Replacement Project under the provisions of the California Environmental Quality Act (CEQA) and the National Environmental Policy Act (NEPA) and included all phases planned for the project.  Based on the environmental review, the project is categorically exempt from the provisions of the CEQA Guidelines under Section 15302, Class 2(c) - Replacement or Reconstruction.  Under Section 15302, a Class 2(c) exemption consists of replacement or reconstruction of existing structures and facilities where the new structures will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced.  It has also been determined that the project is exempt per Section 58.34 (a)(12) of the NEPA Guidelines because the project meets the requirements for a categorical exclusion under Section 58.35 (a)(1).

 

OTHER REVIEWING AGENCIES:

 

The Agreement has been reviewed and approved by the Caruthers Community Services District.
