SUBJECT:                     Agreement for Analytical Water Testing for County Disposal Sites

 

RECOMMENDED ACTION(S):

TITLE

Approve and authorize Chairman to execute an Agreement with BC Laboratories, Inc., to provide State-mandated analytical water testing services for County disposal sites at a maximum annual limit of $83,950 ($69,960 for Basic Services and $13,990 for Extra Services) for a maximum total of $419,750 over the anticipated five-year term of the Agreement.

REPORT

Approval of the recommended agreement with BC Laboratories, Inc. (BC Labs), will provide the required State-certified laboratory testing necessary to conduct the mandated water analyses for Disposal Sites. These analyses are required by the California Regional Water Quality Control Board (RWQCB), in accordance with the Monitoring and Reporting Programs contained within the site specific Waste Discharge Requirements (WDRs) for each site. The recommended agreement is for three years, with the option to renew for up to two additional one-year periods by mutual written consent.

 

ALTERNATIVE ACTION(S):

 

No viable alternative exists. The analytical water testing services are mandated by the State.

 

FISCAL IMPACT:

 

Sufficient appropriations are included in the FY 2017-18 budget as follows: $47,482 in the American Avenue Disposal Site Enterprise Org 9026; $23,988 in the Southeast Regional Disposal Site Enterprise Org 9020; $6,512 in the Coalinga Disposal Site Enterprise Org 9028; and $5,968 in the Resources Division Budget Org 9015 (for the closed Del Rey ($2,984) and Riverdale ($2,984) Disposal Sites).

 

DISCUSSION:

 

The County is mandated to perform groundwater analyses at County Disposal Sites by California Code of Regulations, Title 27, Chapter 3, Subchapter 3, and Waste Discharge Requirements for each site issued by the California Regional Water Quality Control Board.

 

On June 23, 2017, the Internal Services Department, Purchasing Division, issued Request for Quotation (RFQ) No. 17-087, asking bidders to provide a cost for Basic Services, with twenty percent (20%) added for unforeseen disposal site analytical requirements in the form of Extra Services. The bid closed on July 20, 2017, with only one firm responding to the RFQ: BC Labs.

Department of Public Works and Planning, Resources Division staff performed a detailed review of the bid submittal relative to the requirements contained in the RFQ and informed the Purchasing Division of the recommendation to award the agreement to BC Labs on August 2, 2017. BC Labs has been satisfactorily providing analytical services for the disposal sites for the previous thirteen years and indicated in their response to the County’s RFQ that they would comply with every requirement. The annual cost of the proposed agreement is within 8.6% of the annual cost of the previous agreement that was executed in 2013.

 

Public Works and Planning, Resources Division staff recommends that BC Labs be awarded the agreement, as they are the only responsive, responsible bidder and their bid is reasonable.
