SUBJECT: First Amendment to Agreement No. 15-227 with Fresno Pacific University Center for Peacemaking and Conflict Studies for victim and offender reconciliation services for the Probation Department
RECOMMENDED ACTION(S):
TITLE
1. Approve and authorize the Chairman to execute First Amendment to Agreement No. 15-227 with the Fresno Pacific University Center for Peacemaking and Conflict Studies for victim and offender reconciliation services for the Probation Department, effective upon execution with no change in term to June 30, 2020, increasing the contract maximum by $110,484 to $230,484;
2. Adopt Budget Resolution increasing FY 2017-18 appropriations in the Youthful Offender Block Grant Org 3434 in the amount of $26,484 (4/5 vote); and
3. Adopt Budget Resolution increasing FY 2017-18 appropriations and estimated revenues in the Probation Org 3430 in the amount of $26,484 (4/5 vote).
REPORT
There is no increase in Net County Cost associated with the recommended actions as costs associated with this amendment will be funded with Youthful Offender Block Grant funds. Approval of the recommended amendment will allow Fresno Pacific University’s Center for Peacemaking and Conflict Studies (CPACS) to continue to provide victim and offender reconciliation services for the Probation Department. Approval of the recommended amendment will increase the annual compensation amount from $24,000 to $66,000 effective upon execution. CPACS provides restorative justice mediation services between juvenile offenders and victims of crime.
ALTERNATIVE ACTION(S):
If the Board does not approve the recommended actions, services provided by CPACS will likely be reduced or eliminated.
FISCAL IMPACT:
There is no increase in Net County Cost associated with the recommended actions. The amendment will increase the maximum annual compensation for this agreement from $24,000 to $66,000. The agreement maximum will be increased by $110,484 to a total of $230,484.
Recommended actions 2 and 3 will increase the FY 2017-18 appropriations in the Youthful Offender Block Grant Org 3434 and the appropriations and estimated revenues in the Probation Org 3430 by $26,484 to cover the costs of the amendment for the remainder of FY 2017-18. Fund balance in the Special Revenue Fund (Local Revenue Fund 2011) 0271, Youthful Offender Block Grant Org 3434 will be transferred to the Probation Org 3430 to fund the costs of the Amendment. Funding for this agreement in future years will be included in the Department’s Recommended Budgets.
DISCUSSION:
On June 2, 2015 your Board approved Agreement No. 15-227 with the Victim Offender Reconciliation Program (VORP) for the continuation of victim and offender reconciliation services to the Probation Department through June 30, 2020. On October 18, 2016 your Board consented to VORP’s assignment of all of its rights and obligations under Agreement No. 15-227 to Fresno Pacific University’s Center for Peacemaking and Conflict Studies (CPACS).
In addition to funding provided by the County, CPACS receives funding from the California Endowment Foundation to fully cover the costs to administer this program. CPACS annual California Endowment Foundation funding for this program was reduced effective August 31, 2017 and no alternative revenue sources were identified. The Probation Department wishes this program to continue and has available Youthful Offender Block grant funds to make up the loss of funding from the California Endowment Foundation. The first recommended action will authorize an amendment increasing annual compensation provided to CPACS.
The second and third recommended actions will increase the appropriations and estimated revenues to cover the costs of the amendment.
CPACS offers restorative justice and victim offender mediation for youth and their families as an early intervention service. Restorative Justice focuses on the harm caused by crime, repairing the harm done to victims, and requires offenders to take responsibility for their actions and the harm they have caused.
