SUBJECT:                     Retroactive Second Amendment to Agreement with the City of San Joaquin for Law                      Enforcement Services

 

RECOMMENDED ACTION(S):

TITLE

1.                     Approve and authorize Chairman to execute retroactive Second Amendment to Agreement 15-371 with the City of San Joaquin to extend the term of the existing Agreement for law enforcement services by one year from July 1, 2017 to June 30, 2018 ($90,647); and

2.                     Adopt Budget Resolution increasing FY 2017-18 appropriations and estimated revenues for Sheriff-Coroner Org 3111 in the amount of $4,941 (4/5 vote).

REPORT

There is no additional Net County Cost associated with these actions, which allow the Sheriff-Coroner to continue providing an additional thirty hours per week of patrol services and coverage of events such as football games, festivals or other activities for the City of San Joaquin.  This item pertains to locations in District One.

 

ALTERNATIVE ACTION(S):

                                          

Non-approval of the recommended actions will result in the loss of revenue to the Sheriff-Coroner’s Office and services to the City of San Joaquin.

 

RETROACTIVE AGREEMENT:

 

The recommended Second Amendment to Agreement 15-371 is retroactive due to the Master Schedule of Fees (MSF) rates being approved and adopted by your Board on October 31, 2017. The signed agreement was received from City of San Joaquin on December 11, 2017.

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with these actions. The recommended amendment will provide $90,647 in revenue from the City of San Joaquin for overtime provided by a Deputy Sheriff for up to 1,560 hours.

 

The amount of $36,260 will be provided in revenue for up to 650 hours at $54.94 per overtime hour from July 1, 2017 through November 30, 2017 (based on the FY 2016-17 rates as approved by your Board on May 24, 2016). The amount of $54,387 will be provided in revenue for up to 910 hours at $60.43 per overtime hour from December 1, 2017 through June 30, 2018 (based on the new MSF rates approved and adopted by your Board on October 31, 2017 effective December 1, 2017).

 

 

Appropriations and revenues in the amount of $85,706 are included in the FY 2017-18 Sheriff-Coroner’s Org 3111 Adopted Budget and were based on the amount of the prior year agreement with the City of San Joaquin. The second recommended action will increase the appropriations and estimated revenues by $4,941 in Sheriff-Coroner’s Org 3111 for FY 2017-18 to account for the increase in the MSF rates effective December 1, 2017 for Deputy Sheriff services.   

 

DISCUSSION:

 

Since 1988, the City of San Joaquin has contracted for law enforcement services with the Fresno County Sheriff-Coroner’s Office. While no position is assigned to the City of San Joaquin, the City has agreed to pay the Sheriff-Coroner’s Office a flat rate every month for overtime shifts to be worked in the area. The overtime shifts will be assigned at the discretion of the Sheriff to promote public safety to the greatest extent possible with this limited level of service.

 

On August 9, 2016, your Board approved the First Amendment to Agreement #15-371 to provide law enforcement services to the City of San Joaquin effective from July 1, 2016 through June 30, 2017. The proposed amendment extends the term of the existing Agreement through June 30, 2018. Additionally, at the request of the City of San Joaquin and upon agreement of both parties, the Sheriff-Coroner shall provide law enforcement services at special events at the FY 2017-18 Deputy Sheriff overtime rate of $60.43 per hour.
