                     District adding overtime compensation

 

RECOMMENDED ACTION(S):

TITLE

1.                     Approve and authorize Chairman to execute First Amendment to revenue Agreement No. 17-441 with Fresno Unified School District adding overtime compensation for services provided by Deputy Probation Officers at Fresno Unified School District school sites, effective upon execution with no change in term to June 30, 2018 and increasing the maximum by $84,960 to a total of $384,960; and

2.                     Adopt Budget Resolution increasing FY 2017-18 appropriations and estimated revenues in the Probation Org 3430 in the amount of $84,960 (4/5 vote).

REPORT

There is no additional Net County Cost associated with the recommended actions.  In the event of a teacher work stoppage, and at the request of Fresno Unified School District (FUSD), Fresno County Probation shall assign Deputy Probation Officers to provide an increased Probation presence at FUSD school sites. FUSD will provide a maximum of $84,960 for overtime salary costs associated with these services. Due to the collaborative nature of this Agreement, the Department recommends your Board deviate from the County policy requiring full cost recovery (including indirect costs).  This practice is consistently applied to similar Agreements with other school districts. This item pertains to locations in Districts 2, 3, and 5.

 

ALTERNATIVE ACTION(S):

 

There is no viable alternative action.  If the Board does not approve the recommended actions, the Probation Department will not assign Deputy Probation Officers to provide an increased Probation presence at FUSD school sites in the event of a teacher work stoppage.

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended actions. In the event of a teacher work stoppage, the Probation Department shall assign Deputy Probation Officers to provide an increased Probation presence at FUSD school sites. Services shall be provided for a maximum of 10 hours per day for a maximum of 1,500 total hours. FUSD will provide a maximum of $84,960 for overtime salary costs associated with these services based on an hourly rate not to exceed $56.64. Based on the Probation Department’s current indirect rate of 25.96% of salary and benefits, the maximum indirect costs associated with these services are $22,056. It is recommended FUSD’s portion of the indirect not be charged due to the collaborative nature of the Agreement. The second recommended action will increase the FY 2017-18 appropriations and estimated revenues in the Probation Org 3430 by $84,960 to fund the costs of the Amendment.

 

 

 

 

DISCUSSION:

 

The Fresno County Probation Department currently has an agreement with FUSD that assigns eight Deputy Probation Officers to various FUSD campuses to provide Probation services and participate on the Police/Sheriff/Probation Teams. Through this amendment, FUSD desires the Fresno County Probation Department to assign Deputy Probation Officers to FUSD school sites in Fresno to provide an increased Probation presence in the event of a teacher work stoppage. The recommended action will authorize an amendment to the current FUSD revenue agreement adding overtime compensation provided to the Probation Department to be utilized only in the event of a teacher work stoppage.

 

On August 8, 2017, your Board approved Agreement No. 17-411 with FUSD that deviated from the County policy requiring full cost recovery (including indirect costs) due to the collaborative nature of the Agreement. For this Amendment, the Department is recommending your Board continue to deviate from full cost recovery to continue the collaborative nature.
