SUBJECT: Amendments to Fresno County Ordinance Code Title 8 (Health and Safety)

RECOMMENDED ACTION(S):
TITLE
Conduct second hearing and adopt Ordinance amending Fresno County Ordinance Code, Title 8 - Health and Safety, regulating the management, collection and/or disposal of solid waste; and waive reading of the Ordinance in its entirety.
REPORT
On December 5, 2017, the Board conducted the first hearing regarding the proposed amendments to those Chapters of Fresno County Ordinance Code, Title 8, which regulate the management, collection and/or disposal of solid waste. The second hearing was originally scheduled for December 12, 2017, however, to ensure compliance with noticing requirements the item was rescheduled for today's hearing. Today's action is to conduct the second hearing and adopt the proposed amendments. These amendments will take effect in 30 days. This item is countywide.

FISCAL IMPACT:

There are no Net County Costs associated with the recommended actions. Costs for administration and state-mandated reporting for the programs will be funded by fees paid by recycling haulers, and service fees paid by the hauler(s) who execute a Non Exclusive Waste Hauling Agreement (NEWHA). Staff anticipates that funding from these fees will be sufficient; however, staff will return to the Board if funding is determined to be insufficient.

DISCUSSION:

The recommended actions allow for the reorganization, amendment and expansion of those Chapters of Title 8, Health and Safety that address and govern the management, collection and/or disposal of solid waste within the County. These actions will expand certain aspects of the County's regulatory responsibilities and are designed to improve the County's ability to administer, track and quantify all waste generated within the County, in order...
