SUBJECT:                     Agreement with the Malaga County Water District for the Malaga Arriaga Community Center Roof and A/C, Community Development Block Grant Project No. 17451

 

RECOMMENDED ACTION:

TITLE

Approve and authorize the Chairman to execute Agreement with the Malaga County Water District for the Malaga Arriaga Community Center Roof and A/C, Community Development Block Grant Project No. 17451 ($250,000).

REPORT

This Agreement provides Community Development Block Grant (CDBG) funding for the Malaga Arriaga Community Center Roof and A/C Project totaling $250,000.  The project is included in the County’s 2017-18 Action Plan which was approved by the Board on August 8, 2017.  The Malaga County Water District serves areas in Districts 3 and 4, with the project site located in District 4.

 

ALTERNATIVE ACTION:

 

The Board may reject the project and amend the 2017-18 Action Plan to delete the Malaga Arriaga Community Center Roof and A/C Project and direct staff to identify another project on the 2017-18 Back Up list for consideration.  However, deletion of this project may impact the County’s ability to meet its CDBG expenditure timelines, which are set by the U.S. Department of Housing and Urban Development (HUD).

 

FISCAL IMPACT:

 

There is no Net County Cost associated with the recommended action.  The total estimated project cost is $260,000.  CDBG funds in the amount of $250,000 from the County’s unincorporated area allocation are included in the Department’s Community Development Block Grant Org 7205 FY 2017-18 Adopted Budget for the Malaga Arriaga Community Center Roof and A/C Project.  CDBG funds are provided on a reimbursement basis.  The Malaga County Water District will provide all sums of money in excess of the CDBG funds that may be necessary to complete the project.

 

DISCUSSION:

 

On August 8, 2017, the Board approved the 2017-18 Unincorporated Area Projects list as part of the Annual Action Plan, which included the Malaga Arriaga Community Center Roof and A/C Project on the Back Up list should funding become available.  Due to year-end cost savings from other CDBG activities, there are now sufficient funds for this project.

 

The Malaga Arriaga Community Center Roof and A/C Project proposes to add polyurethane foam over the existing metal roof to provide insulation and seal leaks.  The project will also replace existing evaporative coolers with an air conditioning system.  The Project is located at the Malaga Arriaga Community Center, 3582 South Winery Avenue.  The improvements will eliminate leaks in the roof, and provide a cooler and more comfortable environment for users of the center.

 

In addition to providing funds for the project, the Agreement requires that the Malaga County Water District prepare the plans and specifications for the project that conform with Federal and State regulations governing Federally-assisted projects.  The Agreement also provides that the District be responsible for the advertising and awarding of the project to the lowest responsible bidder and for completion of the necessary construction engineering.  The County agrees to review and approve the plans and specifications for compliance with Federal regulations prior to the District advertising of the project for bid.  The Malaga County Water District agrees to maintain the improvements after project completion.

 

Initial Study/Environmental Assessment No. 7381 was completed for the Malaga Arriaga Community Center Roof and A/C Project under the provisions of the California Environmental Quality Act (CEQA) and the National Environmental Policy Act (NEPA).  Based on the environmental review, the project is categorically exempt from the provisions of the CEQA Guidelines under Section 15301, Class 1 - Existing Facilities.  Under Section 15301, a Class 1(d) exemption consists of the restoration or rehabilitation of deteriorated or damaged structures, facilities, or mechanical equipment.  It has also been determined that the project is exempt per Section 58.34 (a)(12) of the NEPA Guidelines because the project meets the requirements for a categorical exclusion under Section 58.35 (a)(3)(iii).

 

OTHER REVIEWING AGENCIES:

 

The Agreement has been reviewed and approved by the Malaga County Water District.
