RECOMMENDED ACTION(S):

TITLE

Approve the appointment of William P. Schwarz to the Coalinga-Huron Park and Recreation Board, for the term expiring December 4, 2020, to fill an unexpected vacancy.

REPORT

ALTERNATIVE ACTION(S):

 

Your Board may order the Coalinga-Huron Park and Recreation Board to call an election to fill the vacancy.

 

FISCAL IMPACT:

 

There is no increase in net County cost associated with this action.

 

DISCUSSION:

 

Government Code Section 1780 provides that when a vacancy occurs in a district, the remaining members of the district board may fill the vacancy either by appointment or by calling an election within sixty days after either the date on which the district board was notified of the vacancy or the effective date of the vacancy, whichever is later.  If the vacancy is not filled by the district board by appointment and the district board has not called for an election, the Board of Supervisors may appoint a person to fill the vacancy or may order the district to call an election to fill the vacancy within ninety days of the date the district board was notified of the vacancy or the effective date of the vacancy, whichever is later.  If there has been no action by the District Board or the Board of Supervisors within 90 days, the district board shall call an election to fill the vacancy.

 

The applicant submitted their application to the Clerk of the Board’s office on March 27, 2018.  Thereafter the Clerk of the Board’s office referred the application to the County Clerk’s Office to determine whether the applicant qualified under applicable law to serve on the District Board.  On March 27, 2018, the County Clerk’s Office confirmed that the applicant qualified to serve on the District Board.

 

By making an appointment, the vacant seat from the unexpected vacancy will be filled on the District Board without the District incurring the cost of an election.  The Fresno County District 4 Supervisor supports this appointment.  On March 28, 2018, the Clerk to the Board’s office received one other application for the position.
