SUBJECT:                     Agreement with the Biola Community Services District for the Biola 5th Street Sidewalk and Storm Drain, Community Development Block Grant Project No. 17031

 

RECOMMENDED ACTION:

TITLE

Approve and authorize the Chairman to execute Agreement with the Biola Community Services District, for the Biola 5th Street Sidewalk and Storm Drain, Community Development Block Grant Project No. 17031 ($300,000).

REPORT

Approval of the recommended action will provide Community Development Block Grant (CDBG) funding for the Biola 5th Street Sidewalk and Storm Drain Project (Project) included in the County’s 2017-18 Action Plan’s Back-Up list approved by your Board on August 8, 2017.  The Project is estimated at $300,000; the Biola Community Services District (District) will provide a local financial contribution for costs beyond the $250,000 CDBG allocation.  This item pertains to District 1.

 

ALTERNATIVE ACTION:

 

Your Board may reject the Project, amend the 2017-18 Action Plan to modify or delete the Project, and direct staff to identify another project from the 2017-18 Back-Up list for consideration.  However, deletion may impact the County’s ability to meet its CDBG expenditure timelines, set by the U.S. Department of Housing and Urban Development.

 

FISCAL IMPACT:

 

There is no Net County Cost associated with the recommended action.  CDBG funds in the amount of $250,000 from the County’s unincorporated area allocation are included in the Public Works and Planning - CDBG Org 7205 FY 2017-18 Adopted Budget for the Project and will be included in the FY 2018-19 budget request.  The funds are provided on a reimbursement basis.  The total estimated cost is $300,000.  The District will provide a local financial contribution in excess of the CDBG funds that would be necessary to complete the Project by August 14, 2019.

 

DISCUSSION:

 

On August 8, 2017, your Board approved the 2017-18 Unincorporated Area Projects list as part of the Annual Action Plan, which included the Biola 5th Street Sidewalk and Storm Drain Project on the Back-Up list should funding become available.  Due to year-end cost savings from other CDBG activities, there are now sufficient funds available for this project.

 

 

The Project proposes to install sidewalk, curb, gutter, and curb ramps along 5th Street from F Street to G Street, extend the storm drain main along F Street from Biola Avenue to 5th Street, and install storm drain inlets and connecting lines at the intersection of 5th and F Streets.  The Project will improve accessibility, drainage, and safety in the area and is expected to be completed by August 14, 2019.

 

In addition to providing local funds in excess of the CDBG funds for the Project, the recommended agreement requires that the District prepare plans and specifications for the Project that conform to Federal and State regulations governing Federally-assisted projects.  The recommended agreement also provides that the District will be responsible for the advertising and awarding of the Project to the lowest responsible bidder and for completion of the necessary construction engineering.  The County agrees to review and approve the plans and specifications for compliance with Federal regulations prior to the District advertising the Project for bid.  The District agrees to maintain the improvements after project completion.

 

Initial Study/Environmental Assessment No. 7395 was completed for the Project under the provisions of the California Environmental Quality Act (CEQA) and the National Environmental Policy Act (NEPA).  Based on the environmental review, the project is categorically exempt from the provisions of CEQA Guidelines under Section 15301, Class 3 - New Construction or Conversion of Small Structures.  Under Section 15303, a Class 3(d) exemption consists of water main, sewage, electrical, gas, and other utility extensions including street improvements, of reasonable length to serve such construction.  An environmental assessment of the project was completed, per NEPA Guidelines, which resulted in a Finding of No Significant Impact.

 

With your Board’s approval, the CDBG allocation for $250,000 will be made to the Biola Community Services District toward the 5th Street Sidewalk and Storm Drain Project, which was listed on the County’s 2017-18 Action Plan Back-Up list.

 

OTHER REVIEWING AGENCIES:

 

The recommended agreement has been reviewed and approved by the Biola Community Services District.
