SUBJECT:                     Resolution increasing the number of members of the Coalinga-Huron Cemetery District Board of Trustees from three to five Members

 

RECOMMENDED ACTION(S):

TITLE

Conduct hearing to consider and adopt resolution increasing the number of members of the Coalinga-Huron Cemetery District Board of Trustees from three to five Members.

REPORT

The Coalinga-Huron Cemetery District (District) was formed in 1957 as an independent special district in Fresno County governed by a three-member board of trustees.  On February 13, 2018, the District Board of Trustees convened, discussed and approved a resolution to request the Fresno County Board of Supervisors to increase the Coalinga-Huron Cemetery Board of Trustees from a three-member to a five-member board. 

 

ALTERNATIVE ACTION(S):

 

Your Board may elect to not increase the number of Board of Trustee Members and appoint qualified residents of the Cemetery District. 

 

FISCAL IMPACT:

 

Approval of the recommended action will have no additional impact on Net County Cost.

 

DISCUSSION:

 

The board of trustees of a public cemetery district in California shall be composed of three or five members. California Health and Safety Code section 9025(a) states, “A board of trustees may adopt a resolution requesting the board of supervisors increase or decrease the number of members of the board of trustees.” Additionally, in section 9025(b) it states that “Within 60 days of receiving a resolution adopted pursuant to subdivision (a), the board of supervisors shall consider the resolution at a public hearing. The board of supervisors shall give notice of its hearing by publishing a notice pursuant to Section 6061 of the Government Code in at least one newspaper of general circulation within the jurisdiction of the district at least 10 days before the hearing. In addition, the board of supervisors shall mail the notice at least 10 days before the hearing to the district and any other person who has filed written request for notice with the clerk of the board of supervisors.”  The Clerk to the Board is aware of the noticing requirements.

 

Currently, the Coalinga-Huron Cemetery District Board (District Board) is a three-member board.  On February 13, 2018, the District Board convened to discuss the District Board’s option of increasing to five members.  At this meeting, a three-member quorum unanimously approved increasing the District Board of Trustees membership from three to five.  On March 7, 2018 the district’s office manager wrote a letter to the Clerk of the Fresno County Board requesting the increase to the Board of Trustees to a five-member board.  This correspondence, along with the meeting minutes indicating the Board’s discussion and vote to increase the Board from three to five members are included with this item. 

 

The statute requires your Board consider the request from the District Board of Trustees at a public hearing, receiving and considering any written or oral comments regarding the request.  After receiving and considering those comments, your Board may adopt a resolution that orders the increase in the number of members of the District Board of Trustees.  Section 9025(d) states that if the Board of Supervisors adopts a resolution that orders an increase in the number of members of the board of trustees, the board of supervisors shall promptly appoint a person or persons to the board of trustees and specify their term of office, consistent with the requirements of this part.  Your Board has a reasonable time to promptly appoint persons to the board of trustees and specify their term of office.
