SUBJECT:                     Assembly Bill 2447 (Reyes) - California Environmental Quality Act: Land Use: Environmental Justice

 

RECOMMENDED ACTION(S):

TITLE

1.                     Authorize the Board of Supervisors to execute letter in opposition of Assembly Bill 2447 (Reyes), as amended April 10, 2018; and

 

2.                     Authorize the Board of Supervisors to execute future letters through the legislative process with similar content in opposition of Assembly Bill 2447 (Reyes).

REPORT

Approval of the recommended actions would authorize the execution of letters in opposition of Assembly Bill 2447 (AB 2447).  AB 2447 would require additional California Environmental Quality Act (CEQA) notices, meetings, and special findings when State and local agencies consider projects involving “subject land uses” in “disadvantaged communities.”

 

ALTERNATIVE ACTION(S):

 

Your Board could choose not to execute the letter of opposition and/or require future letters of opposition to return to your Board for execution; however, that would delay submittal. 

 

FISCAL IMPACT:

 

There is no fiscal impact associated with the recommended actions.

 

DISCUSSION:

 

AB 2447 would require additional CEQA notices, meetings, and special findings when State and local agencies consider projects involving “subject land uses” in “disadvantaged communities.”  Existing law under CEQA, the Planning and Zoning Law, and related statutes provide extensive public noticing and opportunities for public input for all projects.  In addition, existing law provides for a robust public process, typically used for projects of the nature addressed in AB 2447.

 

It is recommended the Board execute the proposed letter in opposition to AB 2447.
