RECOMMENDED ACTION(S):

TITLE

1.                     Approve and authorize Chairman to execute a revenue Agreement with the Kings Canyon School District for services provided by one Deputy Probation Officer assigned to Kings Canyon Unified School District school sites from June 1, 2018 through June 30, 2019 ($43,125);

2.                     Adopt Budget Resolution increasing the FY 2017-18 Appropriations and Estimated Revenue in Probation Org 3430 in the amount $11,006 (4/5 vote); and

3.                     Approve Amendment to the Salary Resolution adding one Deputy Probation Officer position to Probation Org 3430 effective June 4, 2018 as reflected in Appendix C.

REPORT

There is no increase in Net County Cost associated with the recommended actions.  Kings Canyon Unified School District (Kings Canyon USD) and the Probation Department desire a partnership to provide services.  Kings Canyon USD will provide a total of $43,125 which includes $40,625 for salary and benefits and $2,500 for overtime to partially fund one Deputy Probation Officer (DPO) position.  The remainder of the direct costs for this position will be funded with Juvenile Justice Crime Prevention Act (JJCPA) funds.  The Fresno County Probation Department and Kings Canyon USD recognize the benefit of collaborating to provide services and have a DPO participate on the Police/Sheriff/Probation Team located on campus.  Due to the collaborative nature of this Agreement, the Department recommends your Board deviate from the County policy requiring full cost recovery (including indirect costs).  This practice is consistently applied to similar Agreements with other school districts.  This item affects District Four.

 

ALTERNATIVE ACTION(S):

 

There is no viable alternative action.  If the Board does not approve the recommended actions, the Probation Department will not have sufficient funding to provide on campus services to the Kings Canyon USD.

 

FISCAL IMPACT:

 

There is no additional Net County Cost associated with the recommended actions.  The total cost for one Deputy Probation Officer is $156,658 and includes $144,158 in regular salaries and benefits, $2,500 in overtime, and $10,000 in estimated services and supplies, which includes vehicle, radio, and cell phone costs, for the 13-month Agreement period.  Kings Canyon USD will provide a total of $43,125 comprised of $40,625 for regular salary and benefits and $2,500 for overtime towards the costs of one DPO with the remaining $113,533 being funded with JJCPA funds.  Based on the Probation Department’s current indirect rate of 25.96% of salary and benefits, the indirect costs associated with this DPO position are $38,072.  It is recommended Kings Canyon USD’s portion of the indirect not be charged due to the collaborative nature of the Agreement and due to the fact that the DPO is providing supervision to minors who reside within the school district’s boundaries.  The portion of the indirect that can be paid for with JJCPA funds is limited to 0.5% ($568) per JJCPA funding requirements.  Therefore, the Net County Cost for the indirect is $37,504.  These indirect costs as well as the services and supplies associated with this position will be funded with existing appropriations in the FY 2017-18 Adopted Probation Org 3430 Budget.  Approval of the recommended budget resolution will add the associated salary and benefit appropriations ($11,006) and estimated revenues ($11,006) to the FY 2017-18 Probation Org 3430 Adopted Budget. Funding for the remainder of the agreement will be included in Probation’s Requested FY 2018-19 Org 3430 Budget.

 

DISCUSSION:

 

The Kings Canyon Unified School District (Kings Canyon USD) desires the Fresno County Probation Department to assign one Deputy Probation Officer to various Kings Canyon USD school campuses to provide probation services and participate on the Police/Sheriff/Probation Team.  The Deputy Probation Officer assigned to the Police/Sheriff/Probation Team  will work with Kings Canyon USD staff in monitoring school attendance, maintaining school safety, supervising probationers, serving as liaison between the school and the courts, directly supervising student activity, and screening students for various programs. 

 

The relationship that has been developed between Kings Canyon USD and the Police/Sheriff/Probation Team is designed to be preventative in nature. The primary focus is a collaborative effort to closely monitor juvenile probationers attending the school campuses while developing and implementing school based prevention and intervention programs.

 

The Agreement with the Kings Canyon USD differs from the County's model contract in that it contains a mutual hold harmless clause, which has been reviewed and approved by Risk Management.  This has the effect of making each party responsible for losses arising from their own negligent acts.
