SUBJECT:                     Utility Agreements with the Panoche Drainage District and the Water Quality Improvement Joint Powers Authority for the Dos Palos Area for the Outside Canal on Russell Avenue Bridge Replacement Project - Federal Project No. BRLS-5942(195)

 

RECOMMENDED ACTION(S):

TITLE

Approve and authorize the Director of the Department of Public Works and Planning, subject to the review and approval of County Counsel and the Auditor-Controller/Treasurer-Tax Collector, to execute Utility Agreements with the Panoche Drainage District and the Water Quality Improvement Joint Powers Authority for the Dos Palos Area and any amendments that the Director deems necessary for the construction of the Outside Canal on Russell Avenue Bridge Replacement Project ($0).

REPORT

The recommended action will allow the Director to sign Utility Agreements with two agencies affected by the bridge replacement project as required by the California Department of Transportation (Caltrans). This item pertains to a location in District 1.

 

ALTERNATIVE ACTION(S):

 

Your Board may elect not to approve the recommended action, however, the delay caused by returning these agreements to your Board will delay the project’s construction, which is scheduled for fall 2018 when irrigation flows are anticipated to be low.

 

FISCAL IMPACT:

 

There will be no Net County Cost associated with the recommended action. Sufficient appropriations for this Federally funded bridge project will be included in the Department of Public Works and Planning - Road Org 4510 FY 2018-19 budget request.

 

DISCUSSION:

 

This project will replace the structurally deficient Outside Canal Bridge on Russell Avenue with a two-cell box culvert. The existing bridge, which was constructed in 1954, has become submerged as a result of significant groundwater-related subsidence in the area. During construction, a temporary detour will be constructed over a drainage ditch belonging to the Panoche Drainage District.  Construction of the project will also require adjustment of a water valve belonging to the Water Quality Improvement Joint Powers Authority for the Dos Palos Area. Caltrans requires that the County enter into a utility agreement with any affected agency prior to authorizing construction funds.  As of the preparation date of this agenda item, details of the water valve adjustment were still being finalized.  It is requested that your Board authorize the Director to sign the final utility agreements, which will be substantially similar to Attachments A and B. 

 

It is anticipated that construction may begin as early as November 2018 and be completed by February 2019; however, the advertisement of the project is contingent upon the availability of the Federal funds and authorization to proceed by Caltrans. Should funds not be available this Federal fiscal year the project will be constructed during the first non-irrigation timeframe subsequent to authorization by Caltrans.

 

The Department will return to your Board at a later date with a request to award the construction contract.

 

OTHER REVIEWING AGENCIES:

 

The draft Utility Agreements were developed with Caltrans staff based on the standard Utility Agreement Clauses in the Caltrans Local Assistance Procedures Manual.  As of the preparation date of this agenda item, County Counsel had not completed their review of the draft agreements, which, when finalized, will be approved at each agency’s next practicable Board meeting for which the deadlines can be met.
