SUBJECT: Proposition 69 - Support
RECOMMENDED ACTION(S):
TITLE
Adopt Resolution in support of Proposition 69, Transportation Taxes and Fees Lockbox and Appropriations Limit Exemption Amendment.
REPORT
The proposed resolution will establish the County’s support for Proposition 69, a constitutional amendment to prevent new transportation funds, received by Counties as a result of the passage of Senate Bill 1 (SB 1), from being diverted for non-transportation purposes. This item is countywide.
ALTERNATIVE ACTION(S):
If the Board does not approve the recommended action, the County will not have an official position on Proposition 69.
FISCAL IMPACT:
There is no Net County Cost associated with the recommended action.
DISCUSSION:
Fresno County maintains the largest number of road miles in California at over 3,000 miles, and has an estimated deferred maintenance of approximately $724 million.
Senate Bill 1 (Beall), the Road Repair and Accountability Act of 2017, was approved by the Governor on April 28, 2017 to address basic road maintenance, rehabilitation, and critical safety needs on both the State highways and local street and road systems. SB 1 increases per gallon fuel excise taxes, diesel fuel sales taxes, vehicle registration fees, and provides for inflationary adjustments to tax rates in future years.
Proposition 69, which is on the June 2018 ballot, proposes to amend the California Constitution to prohibit the Legislature from borrowing revenues from fees and taxes imposed on vehicles or their use or operation, and from using those revenues other than as specifically permitted in the Constitution. Proposition 69 also exempts appropriations of revenues generated as part of the Road Repair and Accountability Act of 2017 from counting towards the State appropriation limit.
Approval of the recommended action establishes Fresno County’s support for Proposition 69. In addition, the recommended resolution would approve for Fresno County to be listed as a member of the Coalition to Protect Local Transportation Improvements, a diverse coalition of local government, business, labor, transportation and other organizations throughout the State, in support of Proposition 69.
