SUBJECT:                     Agreement with BAART Behavioral Health Services, Inc. for Narcotic Treatment Program Services

 

RECOMMENDED ACTION(S):

TITLE

Approve and authorize the Chairman to execute an Agreement with BAART Behavioral Health Services, Inc. to provide Narcotic Treatment Program services to in-custody clients at the County’s Detention Facilities effective July 1, 2018, not to exceed five consecutive years, which includes a three-year base contract and two optional one-year extensions, total not to exceed $750,000.

REPORT

Approval of the recommended action will allow the Department to deliver mandated and medically necessary Narcotic Treatment Program (NTP) services to in-custody clients at County detention facilities. The agreement will be funded with Behavioral Health Realignment funds, with no increase to Net County Cost.

 

ALTERNATIVE ACTION(S):

 

There is no viable alternative action. If your Board does not approve the recommended action, in-custody clients in Fresno County detention facilities will be without medically necessary NTP services for opioid dependence and the County will be out of compliance with State regulations.

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended action. The agreement is fully funded with Behavioral Health Realignment funds. The annual contract maximum for FY 2018-19 and each subsequent year is $150,000; $750,000 for the five-year term. Sufficient appropriations and estimated revenues will be included in the Departments Org 5630 FY 2018-19 Requested Budget and will be requested in future fiscal year budgets for the balance of the contract term.

 

DISCUSSION:

 

NTP services are provided to clients diagnosed by a physician as having an addiction to opioids and for whom the treatment has been deemed to be a medical necessity. Currently, Fresno County contracts with the three licensed community-based NTP providers for outpatient narcotic treatment services.

 

Detention facilities are mandated by the State to provide NTP services to any inmate who jail medical staff has identified as potentially needing such services, or to an inmate who was receiving these services prior to incarceration. 

 

On February 12, 2018, County Purchasing issued a Letter of Interest (LOI) for NTP services in the County’s detention facilities. BAART Behavioral Health Services, Inc., the current contracted provider for these services, was the sole agency to respond to the LOI. BAART meets all the necessary licensing and certification requirements to provide the requested services.

 

Section 13 of the agreement contains the insurance coverage and language currently approved for use in the County’s model contract.  Risk Management has recently proposed that the insurance coverage and language in the County’s model contract be revised.  County Counsel and Risk Management will be working on these changes over the next several months.  However, the Department has a need to move forward with this contract to address service needs. Additionally, the Department believes the insurance coverage required in Section 13 of the agreement adequately protects the interests of the County in this contract and County Counsel is comfortable signing the agreement as to legal form.  Therefore, it is recommended your Board approve the recommended agreement in its current form.

 

With your Board’s approval, the proposed agreement with BAART will be effective July 1, 2018, provides for unilateral amendments by the County, and allows the Director, or designee, to issue notice of non-renewal. The recommended agreement may be terminated by either party by giving thirty days advance written notice.
