SUBJECT:                     Retroactive State of California Alcoholic Beverage Control Grant Award

 

RECOMMENDED ACTION(S):

TITLE

1.                     Retroactively authorize the Sheriff-Coroner’s previous submittal of a grant application in the amount of $96,631 to the State of California Department of Alcoholic Beverage Control (ABC) 2019 Grant Assistance Program; and

2.                     Approve resolution authorizing the Chairman to execute retroactive Agreement 18G-LA14 with ABC for the project period from July 1, 2018 through June 30, 2019 ($96,631) and authorize the Sheriff-Coroner, or their authorized representative, to sign claims for reimbursement and activity reports for this Agreement.

REPORT

There is no increase in Net County Cost associated with the recommended actions.  The grant application was submitted to the ABC contingent on your Board’s approval.  The ABC has awarded the Fresno County Sheriff-Coroner’s Office a $96,631 grant effective from July 1, 2018 through June 30, 2019.  The grant will fund overtime along with operational expenses and equipment to augment the Vice Unit’s current activities and enable them to more expansively target alcohol-related issues and crimes in Fresno County.

 

ALTERNATIVE ACTION(S):

 

There is no viable alternative action.  The non-approval of this item will result in the loss of the ABC grant funds for FY 2018-19, and will impact the ability of the Sheriff’s Office to support a proactive approach to alcohol-related crimes and incidents in the Vice Unit.

 

RETROACTIVE AGREEMENT:

 

The ABC request for grant applications was published the last week of January 2018 with a filing deadline of March 30, 2018.  In order to meet the filing deadline, the application was previously submitted to the ABC contingent upon your Board’s approval. On June 5, 2018, the Sheriff-Coroner’s Office was notified by the ABC of the grant award and the application and agreement are being brought to your Board at the first available Board date.

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended actions.  The Sheriff-Coroner’s allocation for FY 2018-19 is in the amount of $96,631.  There is no match requirement for the receipt of the funds.  The appropriations and estimated revenue are included in the Sheriff-Coroner’s FY 2018-19 budget request for Org 3111.

 

 

 

DISCUSSION:

 

The last time the Sheriff’s Office was awarded these competitive ABC grant monies was in FY 2015-16 in the amount of $98,546.  The Sheriff-Coroner’s Office was not awarded an ABC grant the last two years in FY 2016-17 and FY 2017-18 due to the granting agency’s non-acceptance of the proposals submitted by the Department.

 

The competitive application was submitted March 14, 2018 to ABC to meet the application deadline, contingent on your Board’s approval.  The Sheriff-Coroner’s Office was awarded $96,631 for FY 2018-19.  The provision of funding from ABC will allow the Sheriff-Coroner’s Office to focus on and significantly address alcohol-related problems throughout the unincorporated areas of Fresno County.  The funding will equip the Sheriff-Coroner’s Office to maintain an aggressive and proactive response toward alcohol related crimes and thus reduce or deter other associated crimes. 

 

The ABC grant will enable the Sheriff-Coroner’s Vice/Intelligence Unit to conduct undercover operations at California State University, Fresno football games; assist and educate local allied agencies; perform Minor Decoy and Shoulder Tap operations; conduct Informed Merchants Preventing Alcohol-Related Crime Tendencies inspections and develop Intel related to social media parties.

 

The grant monies will be used to fund overtime to augment the Vice Unit’s current activities, operational expenses for investigations consisting of Minor Decoy, Shoulder Tap and Under Cover Bar inspections/investigations, small equipment, and travel expenses to attend the annual ABC program conference.

 

The resolution that the Department of ABC requires the County to sign includes a paragraph requiring the County to take responsibility for all liability that arises out of the County’s performance of the agreement and that the Department of ABC and the State disclaim all such liability.  Given the nature of this agreement and the grant money that will be provided to the County, the Sheriff’s Office recommends that the Board adopt the resolution.
