SUBJECT:                     Alcohol and Drug Impaired Driver Vertical Prosecution Program

                     Grant Agreement

 

RECOMMENDED ACTION(S):

TITLE

1.                     Retroactively authorize the District Attorney-Public Administrator’s previous submittal of a grant application to the California Office of Traffic Safety for continuation of the Alcohol and Drug Impaired Driver Vertical Prosecution Program ($731,441);

2.                     Adopt resolution approving and authorizing the Chairman to execute Agreement for the Alcohol and Drug Impaired Vertical Prosecution Program with the California Office of Traffic Safety (OTS) for the period October 1, 2018 through September 30, 2019 ($251,821).

REPORT

There is no increase in Net County Cost associated with the recommended actions, which will allow for the continuation of the Alcohol and Drug Impaired Driver Vertical Prosecution program through September 30, 2019.  To meet the grant filing deadline, the application was submitted to the OTS contingent on your Board’s approval. This item is countywide.    

 

ALTERNATIVE ACTION(S):

 

If the recommended actions are not approved, this program will not be funded for FY 2018-19, which would result in the elimination of one Deputy District Attorney position.

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with these actions.  There is no match requirement for the receipt of the funds.  The department submitted a grant application in the amount of $731,441.  The OTS awarded $251,821 to Fresno County for the Alcohol and Drug Impaired Vertical Prosecution Program for FY 2018-19.  Due to the reduction in funding, one Senior District Attorney Investigator is recommended for deletion in the FY 2018-19 Recommended Budget in order to align FY 2018-19 appropriations and estimated revenues in the District Attorney - Grants Org 2862.

 

DISCUSSION:

 

The goal of the Alcohol and Drug Impaired Driver Vertical Prosecution Program (ADVIPP) is to investigate and vertically prosecute felony alcohol and drug impaired driving cases. The ADVIPP grant program attorney will handle cases throughout each step of the criminal process and work to increase the capabilities of the Office by obtaining and delivering specialized training.  The ADVIPP program attorney will also share information with peers and law enforcement personnel throughout the County and across the State.  The Office will accomplish these objectives as a means to prevent impaired driving and reduce alcohol and drug-involved traffic fatalities and injuries. 

 

The OTS eliminated funding for the Senior District Attorney Investigator for FY 2018-19.  The ADVIPP grant will fund one Deputy District Attorney position to prosecute alcohol and drug impaired driving cases to the fullest extent possible.  Due to the reduction in funding, one Senior District Attorney Investigator position is recommended for deletion during the FY 2018-19 County budget process as noted earlier.

 

If grant funding is eliminated, the Deputy District Attorney position will be deleted.
