SUBJECT:                     Amendment III for Community Development Block Grant FY 2018-19

 

RECOMMENDED ACTION(S):

TITLE

1.                     Approve and authorize the Chairman to execute Amendment III to Agreement No. A-14-697 with the Marjaree Mason Center, Inc., for Community Development Block Grant funded community-based social services, effective October 1, 2018 with no change in term to September 30, 2019 and increasing the maximum by $14,505 to a maximum total of $268,433.

 

2.                     Approve and authorize the Chairman to execute Amendment III to Agreement No. A-14-698 with Boys & Girls Clubs of Fresno County for Community Development Block Grant funded community-based social services, effective October 1, 2018 with no change in term to September 30, 2019 and increasing the maximum by $9,867 to a maximum total of $182,602.

REPORT

Agreements with Marjaree Mason Center, Inc., Boys & Girls Clubs of Fresno County and Westside Youth, Inc. were approved by the Board in 2014 to utilize the Community Development Block Grant (CDBG) for community-based social services.  The Marjaree Mason Center and Boys & Girls Clubs agreements were amended in 2016 and again in 2017 to reduce the agreement maximum compensations.  Approval of the recommended actions will increase the maximum compensation for the Marjaree Mason Center and the Boys & Girls Clubs of Fresno County; however, it will reduce the total maximum compensation for all agreements as the Westside Youth agreement will terminate effective September 30, 2018.  The agreements are funded entirely by CDBG funding with no Net County Cost. This item is countywide.

 

ALTERNATIVE ACTION(S):

 

There is no viable alternative action. If the recommended actions are not approved, community-based social service activities provided under the County's Annual Action Plan will not be delivered to the respective target areas.

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended actions. The maximum cost of the recommended amendments for the period of October 1, 2018 to September 30, 2019 is $109,119, which reduces the total maximum compensation to $592,897 for the term of all the agreements.

Sufficient appropriations and estimated revenues are included in the FY 2018-19 Recommended Budget for the Department of Social Services (DSS) Org 5610. All costs will be fully offset with CDBG funds.

 

DISCUSSION:

 

On December 2, 2014, the Board approved agreements with Marjaree Mason Center (A-14-697), Boys and Girls Clubs of Fresno County (A-14-698), and Westside Youth, Inc. (A-14-699) to provide CDBG funded social service activities in their respective target areas. CDBG is federally funded through Housing and Urban Development (HUD).  All clients benefiting from social service activities funded by CDBG must reside in the unincorporated areas in Fresno County and/or partner cities identified in the Annual Action Plan, and a minimum of 51% of recipients of these services must be low to moderate income as defined by HUD.

 

On January 4, 2016, the DSS Director executed (as authorized by paragraph seven of the agreement) a first amendment decreasing the maximum compensation of the agreements by a total of $6,304, thus reducing the maximum compensation to $607,536. On January 20, 2017, the DSS Director executed a second amendment decreasing the maximum compensation of the agreements by a total of $3,021, thus reducing the maximum compensation further to $604,515.

 

On June 5, 2018, the County’s 2018-19 Annual Action Plan was approved by your Board, which included $109,119 in continued CDBG funding for community-based social service activities.  The Cities of Mendota and Sanger elected not to participate in the County`s Urban County CDBG Program for the 2018-19 Program year, thus the community-based social service activities provided to residents of Sanger and Mendota are no longer eligible for CDBG funding under these agreements. As a result, Westside Youth has become ineligible for funding under this agreement as the entire scope of their response to RFP 952-5293 was to provide services to residents of Mendota.  

 

The 2018-19 Annual Action Plan identified the Marjaree Mason Center, Inc., and Boys and Girls Clubs of Fresno County as the organizations to receive the CDBG funding ($109,119). The DSS, with assistance from the Department of Public Works and Planning, developed a formula to proportionally allocate the available CDBG funding between the remaining two eligible social service providers. The recommended third amendments are effective October 1, 2018 through September 30, 2019.

 

There are County employees serving on the Board of Directors of the Marjaree Mason Center; therefore, a contract between the County and the Marjaree Mason Center is voidable at the option of the Board of Supervisors, pursuant to Fresno County Charter section 41. County Counsel has reviewed the amendment with Marjaree Mason Center, Inc. and will sign as to legal form if the Board of Supervisors chooses to execute the amendment.
