SUBJECT:                     Second Amendment to Agreement No. P-13-612-G with Stantec Consulting Services, Inc.

 

RECOMMENDED ACTION(S):

TITLE

Approve and authorize the Chairman to execute Second Amendment to Agreement No. P-13-612-G with Stantec Consulting Services, Inc. for required groundwater monitoring, sampling, and reporting at the Blue Hills Disposal Site, extending the term by a year and a half from October 15, 2018 to March 30, 2020 and increasing the maximum by $33,000 to a total of $133,000.

REPORT

Approval of the recommended action will add a year and a half to the five-year agreement.  The extension will allow the Department of Public Works and Planning to respond to recent and pending modifications to the requirements imposed by the California Department of Toxic Substances Control (DTSC) for the renewal of the post-closure permit for the Blue Hills Disposal Site (BHDS) and pay for the related additional services.  Stantec Consulting Services, Inc. (Stantec) must be retained until the full extent of changes to the requirements is made known by the regulatory agencies. This item pertains to a location in District 4.

 

ALTERNATIVE ACTION(S):

 

Your Board may choose not to approve the recommended action; however, the County would be unable to comply with recent and pending modifications to the requirements imposed by DTSC for renewal of the post-closure permit for BHDS, resulting in fines of up to $15,000 per day.

 

FISCAL IMPACT:

 

There is no Net County Cost associated with the recommended action. The maximum compensation of the agreement would increase from $100,000 to $133,000 for the term.  Sufficient appropriations are included in the Department’s Resources Org 9015 FY 2018-19 Adopted Budget.

 

DISCUSSION:

 

During the late 1960’s, the Federal government conducted research and determined that pesticide container disposal posed an environmental problem.  In an effort to address that concern, the Federal government encouraged State and local governments to strengthen rules controlling the disposal of such containers.  In 1970, the State requested that the County to develop a pesticide disposal site to address the problem of illegal disposal.  BHDS opened as a Class I Hazardous Waste Disposal Site in 1973 and is located approximately nine miles north of Coalinga in the Coast Range Foothills.

 

 

In 1991, BHDS ceased accepting waste and closure construction consisting of a clay cap was accomplished from September to December 1992, with a post-closure permit granted in 2007, 15 years after completion of closure construction.  DTSC and the California Regional Water Quality Control Board, Central Valley Region (CRWQCB) share responsibilities for oversight of regulatory compliance at BHDS.  Groundwater monitoring at BHDS is required by Title 23, California Code of Regulations and by the site-specific Waste Discharge Requirements, Order No. 99-087, issued by the CRWQCB on October 22, 1999.

 

Stantec was selected as a result of a Request for Quotation issued by the Internal Services Department - Purchasing Division.

 

On October 7, 2013, the initial five-year Procurement Agreement (P-13-612-G) with Stantec for professional services to perform the required groundwater monitoring, analysis, and reporting preparation to comply with the regulatory requirements was executed with a maximum compensation of $100,000.  The agreement was to expire on October 14, 2016, but was extended through October 15, 2018 with a First Amendment on August 24, 2016, with no change to the maximum compensation.  The recommended action will further extend the term of the agreement to March 30, 2020 and increase the contract maximum by $33,000, to $133,000.  The extension will provide the Department sufficient time to comply with the recent and pending modifications to the requirements for renewal of the post-closure permit and funding for the necessary additional services.

 

The post-closure permit expired September 7, 2017 and BHDS has operated since on an interim permit while the regulatory agencies are in the process of modifying the requirements.

 

With your Board’s approval, Stantec will be retained to allow the County to respond to recent and pending modifications to the requirements imposed by the DTSC.
