SUBJECT: Ratify North Central Fire Protection District Ordinance Amendment
RECOMMENDED ACTION(S):
TITLE
Ratify the North Central Fire Protection District Ordinance No. 2018-01, which amends the District Fire Code Ordinance No. 2016-01 prescribing regulations governing conditions hazardous to life and property from fire.
REPORT
ALTERNATIVE ACTION(S):
California Health and Safety Code Section 13869.7 states that the legislative body of the County may ratify, modify, or deny an adopted ordinance and transmit its determination to the district within 15 days of the determination. Any modification or denial of an adopted ordinance shall include a written statement describing the reasons for any modifications or denial. No ordinance adopted by the district shall be effective until ratification by the city, county, or city and county where the ordinance will apply.
FISCAL IMPACT:
There is no increase in Net County Cost associated with the recommended action.
DISCUSSION:
The North Central Fire Protection District (District) found that it is reasonably necessary to make certain changes and modifications in the requirements contained in the rules and regulations adopted pursuant to Section 17922 and 18935, et seq. of the California Health and Safety Code and introduced Ordinance No. 2018-01 at their meeting on June 21, 2018. The purpose of this Ordinance is to amend the District Fire Code Ordinance No. 2016-01 prescribing regulations governing conditions hazardous to life and property from fire.
Health and Safety Code 13869.7 requires the District to provide a copy of the proposed ordinance to the County of Fresno for a 30-day review and comment period. The District provided this information to the County on July 2, 2018. The department of Public Works & Planning reviewed the information and did not have any comments.
