SUBJECT:                     Retroactive Agreement for Juvenile Drug Court Services, Substance Use Disorder and Mental Health Services

 

RECOMMENDED ACTION(S):

TITLE

Approve and authorize Chairman to execute a Retroactive Agreement with Mental Health Systems, Inc., for Juvenile Drug Court Services, Substance Use Disorder and Mental Health Services for Incarcerated Youth at Juvenile Justice Campus, Post-Release Treatment Services, and Intensive Substance Use and Mental Health Services for Youth Incarcerated at the Juvenile Justice Campus, effective November 1, 2018, not to exceed five consecutive years, which includes a two-year, eight-month base contract and two optional one-year extensions, total not to exceed $4,200,000.

REPORT

Approval of the recommended action will allow community-based substance use disorder (SUD) and mental health treatment services to be provided to adolescents involved in the justice system.  The services are funded with Behavioral Health Realignment, Probation Realignment, and Mental Health Services Block Grant (MHBG) monies, with no increase in Net County Cost. The agreement maximum for Fiscal Year 2018-19 is $600,000; the maximum is $900,000 for subsequent years.

 

ALTERNATIVE ACTION(S):

 

There is no viable alternative action. Should your Board not approve the recommended action, current services for justice-involved youth will be terminated. Clients with serious mental illness and SUD will face the negative consequences of termination or interruption of medically necessary treatment.

 

RETROACTIVE AGREEMENT:

 

The recommended agreement is retroactive to November 1, 2018 due to lengthy contract negotiations and delays in revising and finalizing contract language and exhibits in preparation for the Drug Medi-Cal Organized Delivery System (DMC-ODS). The DMC-ODS is an expanded and coordinated system of SUD care, anticipated to go live in Fresno County on January 1, 2019.

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended action. The maximum cost of the Agreement is $4,200,000 over five yearsThe contract costs will be offset by sources including: Behavioral Health Realignment, Probation Realignment, and Mental Health Services Block Grant funds.  Sufficient appropriations and estimated revenues are included in the Department’s Org 5630 FY 2018-19 Adopted Budget and will be included in subsequent budget requests for the duration of the agreement.

 

DISCUSSION:

 

On June 18, 2013, the Board approved Agreement No. 13-395 with Mental Health Systems, Inc. (MHS) for SUD and mental health services for incarcerated and/or Justice-involved youth. On June 12, 2018, your Board authorized Amendment III to Agreement No. 13-395 to extend the expiration of the Agreement from June 30, 2018, to October 31, 2018 due to the volume of RFPs submitted to the Purchasing Division for expiring contracts.

 

On April 16, 2018, Request for Proposal (RFP) No. 18-042 was issued for the following services:

 

Juvenile Drug Court (Outpatient) Services (JDC, Section II.A. of the RFP); Substance Use and Mental Health Services for Youth Incarcerated at the JJC Substance Abuse Unit (SAU, Section II.B.); Post-Release Outpatient Services (PROPS, Section II.C.); and Intensive Mental Health and SUD Services at JJC (New Horizons Program, Section II.D.). 

 

The RFP required bidders to describe service delivery for the proposed programs with an emphasis on evidence-based, outcome-informed treatment methods and utilizing and creating linkages with community agencies.

 

The Department received proposals from two agencies. The bid review committee included members from the Department of Behavioral Health and Probation. The Fresno County Internal Services Department - Purchasing Division monitored and facilitated bid review committee proceedings. The proposals were ranked according to Purchasing Division guidelines based on a combination of proposal content, quality of proposed services, and experience delivering treatment services to the target population. The committee came to a consensus and recommended awarding services to Mental Health Systems (MHS) based on the agency’s complete and responsive proposal, demonstrated knowledge and experience working with the Juvenile Justice population, demonstrated experience collaborating with Probation, and an effective and comprehensive cost proposal.

 

The Department is recommending that your Board authorize and approve the Chairman to execute the Agreement for behavioral health services for Justice-involved youth with MHS.

 

The recommended Agreement is effective November 1, 2018 and will allow the Director, or designee, to issue notice of non-renewal. The recommended Agreement allows for termination without cause by the County upon giving the vendor thirty days’ advance written notice.
