SUBJECT:                     Community Recidivism Reduction Grant - Fourth Amendment to Agreement

 

RECOMMENDED ACTION(S):

TITLE

1.                     Approve and authorize the Chairman to execute Amendment IV to Agreement #15-243 with the Poverello House for community recidivism and crime reduction services, effective upon execution with no change in term to June 30, 2019 and increasing the contract maximum by $8,177 to a total of $134,751; and

2.                     Adopt Budget Resolution increasing FY 2018-19 appropriations for the Community Recidivism Reduction Grant Org 3451 in the amount of $8,177 (4/5 vote).

REPORT

There is no Net County Cost associated with the recommended actions, which will re-allocate $8,177 of interest on Community Recidivism Reduction Grant (CRRG) funds to the Poverello House, with payments of such additional funds spread over the final six months of FY 2018-19.

 

ALTERNATIVE ACTION(S):

 

If your Board does not approve the recommended actions, any unexpended CRRG funds as of June 30, 2019 shall revert back to the state General Fund.  

 

FISCAL IMPACT:

 

There is no Net County Cost associated with the recommended actions.  The California Budget Acts of 2014 and 2015 allocated $250,000 and $125,000 in CRRG funds respectively to Fresno County, and the Board approved contracts to allocate these funds.  The $8,177 is interest that has accrued on these funds and is being brought to your Board for allocation to the Poverello House. 

 

Approval of the second recommended action will increase FY 2018-19 appropriations for the CRRG Org 3451 in the amount of $8,177 using available Fund Balance to allocate these funds to the Poverello House.

 

DISCUSSION:

 

The purpose of the CRRG is to provide funding to nongovernmental entities or a consortium of nongovernmental entities that provide community recidivism and crime reduction services to persons who have been released from state prison, county jail, or a juvenile detention facility, who are under the supervision of parole or a probation department, or any other person at risk of becoming involved in criminal activities.  Community recidivism and crime reduction services include, but are not limited to delinquency prevention, homelessness prevention, and reentry services.

 

The California Budget Act of 2014 allocated $8 million in one-time funding for the CRRG of which Fresno County received $250,000.  In addition, the California Budget Act of 2015 allocated an additional $4 million to the BSCC for CRRG of which Fresno County received $125,000. 

 

The following is a timeline list of the agreements and subsequent amendments:

 

                     June 16, 2015 - the Board approved five CRRG service agreements with nongovernmental entities as follows:  Boys and Girls Clubs, Youth Centers of America, Focus Forward, Poverello House, and Alliant.  The agreements were effective July 1, 2015 after staff completed a competitive bid process for the 2014 CRRG funds.

                     June 7, 2016 - the Board approved the first amendment for 2015 CRRG funds.  These amendments increased the agreement maximum for four of the five vendors, and extended the term one year for all five vendors.  Alliant did not receive 2015 funding, but received an extension of one year in order to expend the balance of their 2014 CRRG funds ($30,270). 

                     June 6, 2017 - the Board approved second amendments for Local Innovation Subaccount funds.  The second amendments increased the agreement maximums and extended the term one year for four of the five vendors; Alliant did not receive these funds.

                     September 26, 2017 - the Board approved a third amendment to the agreement with the Poverello House.  As of June 30, 2017 (the end of the one year extension), Alliant had an unexpended balance of $10,254 in 2014 CRRG funds.  Your Board reallocated these funds to the Poverello House in the third amendment as they had exceeded the goals set out in their scope of work and any 2014 CRRG funds unexpended as of June 30, 2018 would have reverted to the state General Fund.

 

It should be noted, Government Code Section 30029.07(b) provides that beginning in FY 2015-16, each county treasurer, city and county treasurer, or appropriate official shall transfer to the Local Innovation Subaccount ten percent of the money received during the fiscal year from the following accounts:  Trial Court Security Growth Special Account, the Community Corrections Growth Special Account, the District Attorney and Public Defender Growth Special Account, and the Juvenile Justice Growth Special Account. Accordingly Government Code Section 30025 (f)(15) provides that these funds are to be used to fund local needs and your Board has the authority to spend the money deposited into this account as it would any funds in the above-mentioned accounts.  The Local Innovation Subaccount funds that were utilized for the second amendments are the FY 2015-16 allocation.  Staff will return to your Board with recommendations for the allocation of the FY 2016-17 and FY 2017-18 funds.

 

The recommendation to allocate the $8,177 in CRRG interest funds is being brought to your Board based on the Poverello House exceeding the goals set out in their scope of work by 302%.  Below is a brief summary of the services provided by the Poverello House:

 

The Poverello House utilizes CRRG funding to work with adult male offenders who have completed Poverello’s residential drug/alcohol treatment program, and are currently in their Aftercare Program.  The Poverello House's programs are evidence based, e.g. utilizing Cognitive Behavioral Therapy and case management integrated with 12-Step and other support groups.  The Poverello House has implemented what is called a Workout Program, which focuses on employment and community living.  The Program provides an expanded case management/employment phase that includes transitional housing, assistance with employment; completion of court-mandated classes such as batterers’ intervention and Driving Under the Influence; assistance with driver's licenses, social security cards, health coverage, high school diploma/General Education Development, and child support to reduce barriers for successful reintegration into the community. 

 

The current contract amount is $126,574 for a time period of July 1, 2015 through June 30, 2019 (four-year period).  It is recommended the contract increase by $8,177 for a total of $134,751.
