SUBJECT:                     Retroactive Agreement with Fresno Unified School District for Law Enforcement                                           Services

 

RECOMMENDED ACTION(S):

TITLE

Approve and authorize the Chairman to execute retroactive Agreement with the Fresno Unified School District for law enforcement services effective August 13, 2018 through June 30, 2019 ($159,690).

REPORT

Approval of the recommended action will allow the department to provide law enforcement services to the Fresno Unified School District (FUSD) with the assignment of one Deputy Sheriff position during the school year to Wawona Middle School. This item pertains to a location in District 3.

 

ALTERNATIVE ACTION(S):

 

If your Board does not approve the recommended action, the Sheriff’s Office would be required to discontinue providing these specified services to the Fresno Unified School District due to loss of funding and the subsequent elimination of one Deputy Sheriff position.

 

RETROACTIVE AGREEMENT:

 

This recommended agreement is retroactive due to Master Schedule of Fees (MSF) rates being approved and adopted by your Board on October 9, 2018, after the school year started for Fresno Unified School District and the length of time required for negotiation and approval of the agreement. The signed agreement was received from Fresno Unified School District on January 16, 2019.

 

FISCAL IMPACT:

 

There is no additional Net County Cost associated with this action. The recommended agreement will provide $159,690 in revenue from the Fresno Unified School District for services provided by one Deputy Sheriff for up to 1,500 hours at $106.46 per hour. In addition, the recommended agreement allows for Special Events services at the request of the Fresno Unified School District at the overtime hourly rate of a Deputy Sheriff III. On September 25, 2018, your Board approved the first hearing of the MSF rates as recommended with the exception that the fee amount for Deputy Sheriff III remain at the FY 2017-18 rates for regular and overtime. On October 9, 2018, your Board approved the amendment to the MSF rates as recommended during the first hearing.

 

The Net County Cost associated with this agreement is $11,625. The difference represents FY 2018-19 actual costs for one Deputy Sheriff ($171,315) and the estimated revenue from Fresno Unified ($159,690) based on the MSF rates approved by your Board, as noted earlier. The Sheriff-Coroner-Public Administrator’s FY 2018-19 Adopted Budget Org 3111 contains sufficient appropriations and estimated revenues to cover these costs.

 

DISCUSSION:

 

On February 20, 2018, your Board approved Agreement #18-058 to provide law enforcement services to the Fresno Unified School District with the assignment of one Deputy Sheriff position during the school year effective February 20, 2018 through June 30, 2018. Duties included intervention, prevention, education and enforcement activities at Wawona Middle School. The approval of the recommended action will approve the agreement for law enforcement services from August 13, 2018 through June 30, 2019. Additionally, at the request of the school and upon agreement of both parties, the Sheriff shall provide law enforcement services at the school’s special events at the Deputy Sheriff overtime rate of $60.43 per hour.

 

This agreement requires mutual indemnification and requires the County to comply with certain insurance provisions, such as carrying certain levels of Commercial General Liability, Automobile Liability, Professional Liability, Workers’ Compensation, and Molestation coverages.  The agreement also contains additional requirements relating to insurance.  The foregoing requirements are similar to the requirements the County places on contractors providing services to the County.  The Sheriff’s Office has confirmed with Risk Management that the County can and will comply with the insurance requirements in the agreement.  Furthermore, Sheriff’s Office feels that the insurance requirements are appropriate given that the County is the service provider.
