RECOMMENDED ACTIONS:

TITLE

1.                     Approve and authorize the Chairman to execute a retroactive grant Application/Revenue Agreement and Articles, Assurances, Certifications, Terms and Conditions, and Governing Body Resolution for submission to the California Governor’s Office of Emergency Services for the FY 2018 Emergency Management Performance Grant, effective July 1, 2018 through June 30, 2019 ($656,490).

 

2.                     Approve and authorize the Chairman to execute the Proof of Authority Letter assuring the California Governor’s Office of Emergency Services that the County will provide and appropriate all matching funds, including any cash match, required for the Emergency Management Performance Grant, affirming liability arising from performance of the agreement will be the County’s responsibility, and that funds will not be supplanted.

REPORT

Approval of the recommended actions will allow the Department of Public Health to submit the non-competitive application/revenue agreement for the Emergency Management Performance Grant (EMPG) to the California Governor’s Office of Emergency Services (Cal OES).  The grant funds support the prevention, preparation, mitigation, response, and recovery from emergencies and disasters.  The local allocation ($328,254) provides Federal funds to assist state, local, territorial, and tribal governments to prepare for hazards, as authorized by Section (§) 662 of the Post-Katrina Emergency Management Reform Act (6 U.S.C. §762) and the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. §§ 5121, and following).  The application/revenue agreement and related documents represent the agreement with Cal OES and require a 100% County match ($328,254), which will be funded with Health Realignment, with no Net County Cost. This item is countywide.

 

ALTERNATIVE ACTION(s):

 

Should your Board not approve the recommended actions, the Department would not be able to fund the County’s OES resulting in a decreased level of local emergency preparedness and response coordination.

 

RETROACTIVE AGREEMENT:

 

The recommended FY 2018 EMPG application/revenue agreement was received from Cal OES on October 16, 2018 and is retroactive to July 1 2018.

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended actions.  The maximum compensation for the recommended application/revenue agreement is $656,490; the grant allocation ($328,254) represents an increase of $829 over the prior year level and is non-competitive, based on a population growth model and requires a 100% County match ($328,254), which will be funded with Health Realignment.  Sufficient appropriations and estimated revenues are included in the Department’s Org 5620 FY 2018-19 Adopted Budget.  The grant allows for full reimbursement of direct costs and 10% ($32,825) for indirect costs.  The Department’s indirect cost is 25.42%; Health Realignment will cover the remaining 15.42% ($50,617) in indirect cost.  

 

DISCUSSION:

 

EMPG supports the County’s ability to prevent, prepare for, mitigate against, respond to, and recover from emergencies and disasters, whether natural or man-made.  Federal EMPG funds are allocated through Cal OES annually, as authorized by §662 of the Post-Katrina Emergency Management Reform Act (6 U.S.C. §762) and the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. §§5121, and following).

 

The Department has received EMPG grant funds since the early 1990’s. Prior grants funded the development and updates of emergency response plans, enhancements to the County’s Emergency Operations Center, emergency communications vehicle radio upgrades, and emergency response equipment upgrades.  The recommended application/revenue agreement will provide $328,254 in grant revenue and requires a 100% County match ($328,254) to support OES operations and activities including personnel, program costs, and emergency preparedness training.  The funds will also provide funding for the annual maintenance and support costs associated with the crisis information management system or web-based Emergency Operations Center (WebEOC).  WebEOC provides emergency response agencies with a common access point with real time information and resource tracking, situation analysis, communication, and dissemination of information during an emergency or significant event.

 

The recommended application/revenue agreement and Assurances, Certifications, Terms and Conditions, and Governing Body Resolution will become a binding agreement upon execution by Cal OES and is effective July 1, 2018 through June 30, 2019.  The agreement does not allow for termination without cause; however, the County and Cal OES may terminate from the agreement for non-compliance with the award assurances or terms and conditions issued by the Federal Emergency Management Agency. The terms also state the County shall be responsible for any liability arising out of the performance of this agreement.
