SUBJECT:                     Amendment to Cooperative Project Agreement with Fresno County Transportation Authority

 

RECOMMENDED ACTION(S):

TITLE

Approve and authorize the Chairman to execute a retroactive Amendment No. 4 to Cooperative Project Agreement No. 09-595 with the Fresno County Transportation Authority for Rural Project 1 - Mountain View Avenue Widening to re-allocate funding from the Construction to the Right-of-Way fund, reduce funding for the Preliminary Engineering and Construction phases, extend the term by one year from July 1, 2018 through June 30, 2019, and decrease the maximum by $5,042,979 to $18,495,021.

REPORT

Approval of the recommended action will re-allocate $48,444 from the Construction fund of the Mountain View Avenue Widening Project (Project) to the Right-of-Way fund; reduce $12,859 from the Preliminary Engineering fund and $5,030,120 from the Construction fund, thus reducing the total contract amount to $18,495,021.  In addition, the recommended amendment will extend the term to allow for submission of the final invoice.  This item pertains to a location in District 1. 

 

ALTERNATIVE ACTION(S):

 

No viable alternative action has been identified. Not approving the recommended action will result in de-obligation of the allocated funding.

 

RETROACTIVE AGREEMENT:

 

The recommended amendment is retroactive to July 1, 2018, as the Fresno County Transportation Authority (FCTA) requires a current agreement to close out the project.

 

FISCAL IMPACT:

 

There is no Net County Cost associated with the recommended action. Project costs are 100% funded by the Measure “C” Extension up to $18,495,021 programmed in the Measure “C” Extension Strategic Implementation Plan (SIP). In Amendment No. 3 to the agreement, the FCTA approved reimbursement of Measure “C” funds up to $23,538,000; however, construction costs were significantly less than the Project estimate. Right-of-Way fund was underfunded by $48,444, requiring the re-allocation from the excess Construction funds. The remaining $5,042,979, allocated for preliminary engineering ($12,859) and construction ($5,030,120) but not used, will be returned to Measure “C” for use on other projects.  Funds received from Measure “C” will be deposited in the Department of Public Works and Planning - Road Fund 0010.

 

DISCUSSION:

 

The purpose of the Project is to provide congestion relief to traffic flow, enhance safety on the regional transportation and circulation system in the southern part of the County.  Various traffic studies determined that the number of travel lanes along Mountain View Avenue would not be sufficient to accommodate traffic demands by the year 2030.  The construction phase of the Project between Bethel Avenue and the Tulare county line at Smith Avenue was completed by May 2017. Completion of the Project and the adjacent Avenue 416/El Monte Way Project in Tulare County resulted in a continuous four-lane facility from State Route 99 to the town of Orosi, east of the City of Dinuba. 

 

The recommended amendment will reallocate funds from the Construction fund to the Right-of-Way fund and reduce the maximum compensation because of the decreased Project construction costs. The term of the agreement will be extended to accommodate project closeout and final invoicing. 

 

The FCTA is authorized to approve and revise project funding in accordance with the agreement, SIP, and the Fresno County Measure “C” expenditure plan. Upon approval by your Board, Amendment No. 4 will go before the FCTA Board at February 6, 2019 meeting.
