RECOMMENDED ACTION(S):

TITLE

Approve and authorize the Chairman to execute an Agreement with California State University, Fresno Foundation through its Central Valley Health Policy Institute, for comprehensive evaluation of nutrition education and obesity prevention services, effective upon execution through September 29, 2023, not to exceed four-years seven-months, which includes a two-year seven-month base contract with two optional one-year extensions, total not to exceed $540,000. 

REPORT

Approval of the recommended action will allow the Department of Public Health to continue required evaluation of Nutrition Education and Obesity Prevention (NEOP) program activities through California State University, (CSU) Fresno Foundation, Central Valley Health Policy Institute (CVHPI). The California Department of Public Health (CDPH) NEOP grant will fund the recommended agreement, with no Net County Cost. This item is countywide.

 

ALTERNATIVE ACTION(S):

 

There is no viable alternative action.  Should your Board not approve the recommended action, the Department would be unable to fulfill required evaluation services under revenue Agreement No. 16-589 with CDPH.

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended action. The initial seven months and annual maximum cost thereafter is $108,000; $540,000 for the term. In the first seven months, CVHPI will assist in the development and implementation of the 2020-2022 NEOP grant scope of work and evaluation services.  The NEOP grant, provided by CDPH, will fully fund the recommended agreement. Sufficient appropriations and estimated revenues are included in the Department’s Org 5620 FY 2018-19 Adopted Budget, and will be included in subsequent fiscal year budget requests.

 

DISCUSSION:

 

On February 28, 2017, the Board approved Agreement No. 17-053 with the Sarah Samuels Center for Public Health Research and Evaluation (Samuels Center) for evaluation of the NEOP grant program scope of work activities. On May 31, 2018, the Samuels Center notified the Department that they were going out of business as of August 31, 2018 and would be unable to fulfill the last year of the required NEOP grant activities.

 

 

On October 30, 2018, the Internal Services Department - Purchasing Division (ISD - Purchasing) issued RFP No. 19-025 to solicit prospective bidders to provide comprehensive evaluation services of the nutrition education services and policy, system, and environmental change efforts of the Department’s NEOP program.  Notices were sent to 12 evaluation service vendors identified by the Department in addition to publishing it on the Public Purchase website. The RFP closed on November 20, 2018 with no bids submitted.

 

ISD-Purchasing instructed the Department to seek any known vendors who were qualified to provide the evaluation services. Based on experience working with CSU Fresno Foundation’s CVHPI, the Department made contact and found the vendor to be qualified and interested in providing the evaluation services. Through the recommended agreement, CSU Fresno Foundation’s CVHPI will evaluate year three of the NEOP grant scope of work activities, and assist in development and implementation of the overall NEOP evaluation for Federal Fiscal Year 2020-22.

 

The recommended agreement with CSU Fresno Foundation contains non-standard termination language allowing CSU Fresno Foundation to terminate without cause with 30 days advance written notice, and non-standard hold harmless language limiting CSU Fresno Foundation’s indemnification requirements to the extent of their fault. The nature of CSU Fresno Foundation’s scope of work does not involve protected health information, medical diagnoses, or other sensitive material.  County Counsel has advised the risk of harm from this agreement is relatively low; therefore, the Department recommends the agreement with CSU Fresno Foundation.
