SUBJECT:                     First Amendment to Agreement with Durham Construction Company,

                     Inc.

 

RECOMMENDED ACTION(S):

TITLE

Approve and authorize the Chairman to execute a First Amendment to Agreement No. 18-297 with Durham Construction Company, Inc. for Job Order Contracting, effective upon execution, with no change in term to June 4, 2019, and increasing the maximum by $2,000,000, to a total of $4,000,000.

REPORT

Approval of the recommended action will allow the Internal Services Department - Facility Services Division (ISD Facility Services) to fulfill unexpected Job Order Contracts (JOC) with Durham Construction Company, Inc. (Durham). This Agreement expires on June 4, 2019. This item is countywide.

 

ALTERNATIVE ACTION(S):

 

Should your Board not approve the recommended action, ISD Facility Services may be unable to fulfill departmental JOC work requests.

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended action. All costs associated with these services are recovered through charge-backs to user departments. Sufficient appropriations and estimated revenues are included in the Department’s Facility Services Org 8935 FY 2018-19 Adopted Budget. Appropriations for continued JOC services will be included in future budget requests.

 

DISCUSSION:

 

Public Contracts Code §20128.5 authorizes a Board of Supervisors to award annual JOC agreements. A Job Order Contract is an annual agreement for a fixed term or a maximum dollar value, whichever occurs first. Contractors are selected based on a competitive bid to perform various job orders during the life of the contract. A JOC is used on a per-job basis as requested by County departments for repair, remodeling, or other repetitive work. It offers a fixed price, fast procurement process, with the ability to accomplish an indefinite quantity of projects. This allows for savings in staff time and resources by avoiding project development and bid solicitation for each project. A JOC is also structured to provide transparency and auditability.

 

On June 5, 2018, the Board executed Agreement No. 18-297 for JOC services with Durham, with a maximum compensation amount of $2,000,000 for its 1-year term. Approval of the recommended action will increase the maximum compensation amount by $2,000,000, for a total potential compensation amount of $4,000,000, pursuant to Public Contracts Code §20128.5. This will allow ISD Facility Services to procure JOC services for the Fresno County Assessor-Recorder’s recently purchased building. This Agreement expires on June 4, 2019. All other terms of the Agreement remain unchanged.
