SUBJECT:                     First Amendment to Agreement with Turning Point of Central California, Inc.

 

RECOMMENDED ACTION(S):

TITLE

Approve and authorize the Chairman to execute First Amendment to Agreement No. A-19-039 with Turning Point of Central California, Inc., for transitional housing beds, sustenance, and associated services, effective upon execution with no change in term to January 31, 2024 and increasing the maximum by $3,000,000 to a total of $6,000,000.

REPORT

There is no Net County Cost associated with the recommended action as all costs for this agreement are fully offset with Public Safety Realignment Act (Assembly Bill 109) revenue. Approval of the recommended amendment would increase the annual maximum compensation from $600,000 to $1,200,000, and the total maximum compensation from $3,000,000 to $6,000,000. This increased maximum compensation is necessary in order to increase the average number of occupied beds in the program, which will enable the Probation Department to meet its transitional housing needs and receive the most cost effective pricing. This item is countywide.

 

ALTERNATIVE ACTION(S):

 

If the recommended action is not approved, the annual maximum compensation will remain at $600,000 and the total maximum compensation will remain at $3,000,000. In addition, the Probation Department would not be able to meet their transitional housing needs or receive the most beneficial pricing based on the average number of occupied beds.

 

FISCAL IMPACT:

 

There is no Net County Cost associated with the recommended action. Funding for this agreement is fully offset with Assembly Bill 109 revenue. The maximum annual compensation for this agreement with the recommended First Amendment is $1,200,000, with a maximum compensation for the full 5 year term totaling $6,000,000. Appropriations and estimated revenues are included in Probation’s FY 2018-19 Adopted Org 3430 Budget. Funding for subsequent years of this Agreement will be included in the Department’s future budget requests.

 

DISCUSSION:

 

On January 29, 2019, the Board approved Agreement A-19-039 with Turning Point of Central California, Inc., to provide transitional housing beds, sustenance, and associated services with an annual funding level of $600,000. Based upon the current funding level, the Department will be able to maintain approximately five occupied beds at a rate of $363.06 (rate for 1-10 occupied beds) for an entire year. At that time, the Department explained that it was planning to go before the Community Corrections Partnership (CCP) to request additional Assembly Bill 109 funding to be able to provide an increase in the average number of occupied beds to meet transitional housing needs.  It should be noted, the Department has maintained occupancy at a minimum of 41 beds in order to continue to receive the best daily bed rate of $67.55 (rate for 41-50 occupied beds).

 

On March 11, 2019, the CCP approved an increase in the allocation for transitional housing services to $1,200,000 annually. The recommended First Amendment will increase the annual maximum compensation from $600,000 to $1,200,000, and the total Agreement maximum compensation from $3,000,000 to $6,000,000 to match the increased CCP allocation for transitional housing services. The increased maximum compensation will allow the Probation Department to maintain an average of approximately 49 occupied beds at an all-inclusive per bed per day rate of $67.55.
