SUBJECT:                     Workforce Innovation and Opportunity Act Mandated Partner Memorandum of Understanding -County of Fresno Department of Social Services

 

RECOMMENDED ACTION(S):

TITLE

Approve and authorize the Chairman to execute a Memorandum of Understanding (MOU) between the Fresno Regional Workforce Development Board (FRWDB) and the County of Fresno Department of Social Services for the provision of workforce development services, effective July 1, 2019 through June 30, 2022, total not to exceed $129,339.

REPORT

There is no additional Net County Cost associated with the recommended action, which will allow the FRWDB to operate the Fresno-based America’s Jobs Centers of California (AJCC) in accordance with the Workforce Innovation and Opportunity Act (WIOA). The AJCC will provide workforce development services to residents of Fresno County. The agreement maximum for each contract year is $43,113. This item is countywide.

 

ALTERNATIVE ACTION(S):

 

There is no alternative action. If a Memorandum of Understanding is not executed and in effect with each mandated partner by July 1, 2019, Fresno County will be out of compliance with WIOA requirements and could lose funding for WIOA activities that benefit the residents of Fresno County.

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended action. The maximum amount of the Agreement ($129,339) will be offset with State and Federal Social Services funds ($110,898), County match comprised of 2011 Realignment ($11,910), 1991 Realignment ($5,861) and budgeted Net County Cost ($670) for the General Relief share. Sufficient appropriations and estimated revenues have been included in the FY 2019-20 Recommended Budget for the Department of Social Services, Organization 5610, and will be included in subsequent budget requests.

 

DISCUSSION:

 

The United States Congress passed the WIOA as an enhancement to the previous Workforce Investment Act of 1998. WIOA was signed into law by President Barack Obama on July 22, 2014 and the law took effect on July 1, 2015. The WIOA mandates that certain Federal, State, and local agencies formally partner with local Workforce Development Boards at what is now known as AJCC, in order to refer clients between the partners for specific services to better serve the community and leverage resources from multiple sources, as appropriate.

 

WIOA requires that MOUs be reviewed, updated as needed and renewed every three (3) years. This is the first renewal.

 

These entities are designated as mandated partners per WIOA:

 

                     State of California Employment Development Department

                     Representatives of Community Services Block Grant Act

                     Representatives for Older Americans

                     Department of Rehabilitation

                     Fresno County Department of Social Services

                     Representatives of Adult Education/Community Colleges

                     Representatives for Native Americans

                     Representatives for Migrant Seasonal Farmworkers

                     Job Corps

 

The initial MOU process was split between Phase I and Phase II, where Phase I established the AJCC system, partnerships and shared services. These Phase I agreements were completed in July 2016. Phase II established the Resource Sharing Agreements (RSA), which have been renamed in the current MOU as Infrastructure Funding Agreements (IFA), between the local board and the co-located partners. The purpose of the IFAs is to share equitably in the infrastructure cost of running the One-Stop System. These IFAs also document the total estimated costs of Career Services provided to the community by collocated staff for all partners. The Department’s anticipated in-kind contribution for FY 2019-20 is $722,897.  As these IFAs are required to be reviewed, renegotiated, and renewed every year, the Department will return to your Board annually for approval.

 

FRWDB staff is in final negotiation with all mandated partners for the 2019 renewal.

 

The Fresno County Department of Social Services MOU is based on the template approved by the Board at its meeting on May 7, 2019.
